The Solicitors’ Remuneration Enforcement Committee (SREC)’s objectives are to:
(1)
Enforce the Solicitors’ Remuneration Ordinance (SRO);
(2)
Educate both the Members of the Bar and the public as to the benefits of compliance with the SRO;
(3)
Assist Members in their queries;
(4)
Attend to and check the Returns;
(5)
Conduct visits and attendances;
(6)
File complaints against Members who are in breach of the SRO; and
(7)
Arrange dialogues between SREC and the relevant authorities.
SREC had met five times as at the writing of this report, in June, July, Aug, Sept and Oct. The next meeting is scheduled to take place on 20 Nov 2009.
(1) Visits
To date, SREC has conducted visits to firms in Johor Bharu and Kuantan. SREC members visit firms to:
(a)
Investigate whether the solicitors have received their full professional fees;
(b)
Determine whether there are any occurrences of undercharging or overcharging of clients; and
(c)
Ensure that solicitors charge clients as per the scale fees.
(2) Notice to attend personally
SREC has conducted only one attendance wherein a partner of the firm was asked to appear before SREC members, and explain the breaches, discrepancies and non-compliance with the SRO.
(3) Notice to complete and deliver a Return
To ensure compliance with the SRO, Notices are sent out to legal firms requesting them to complete and deliver Returns (including supporting documents). SREC has sent out Notices to 5,711 firms, starting with Bar Council members, SREC members, and followed by Members of the Bar. In previous years, the firms were requested to submit Returns on conveyancing transactions. For this year, all Members are only required to submit their Returns for loan facilities. This exercise was completed on 11 Nov 2009, ahead of its targeted deadline of 30 Nov.
