By virtue of P.U.(B) 119 dated 15 April 2009, the Legal Profession Qualifying Board, Malaysia (‘LPQB’) has declared that any person who has passed the final examination conducted by Universiti Utara Malaysia (‘UUM’) and Multimedia University (‘MMU’) leading to the degree of Bachelor of Laws (Honours) is a “qualified person” for the purposes of the Legal Profession Act 1976 (Act 166) with effect from 16 March 2008 for UUM graduates and 10 August 2008 for MMU graduates. Thus, a law graduate from UUM and MMU is exempted from the CLP Examination.
The LPQB had also further decided that the said graduates are given an exemption from the CLP Examination on condition that the graduates are required to undergo the Training Programme on Conveyancing Practice, Drafting Pleadings and Opinion Writing conducted by the Bar Council and obtain a Certificate of Completion of the said training during their pupillage.
In the meeting held on 26 November 2012, the LPQB has decided that holders of the Bachelor of Laws (Honours) degree from MMU for the 2009/2010 intake session and thereafter would no longer need to attend the abovementioned Training Programme.
The conditional exemption still applies for holders of the Bachelor of Laws (Honours) degree from UUM. UUM continue to submit regular reports on the extent of compliance with several conditions imposed by the LPQB in the meeting held on 6 December 2011, following the Review Visit to UUM from 19 – 21 March 2011.
As regards the Bachelor of Laws (Hons) programme at Universiti Sultan Zainal Abidin (‘UniSZA’), Kuala Terengganu, the LPQB has, in the meeting held on 1 November 2013, considered the “Report and Recommendations by the Evaluation Committee Established by the LPQB to Evaluate the LLB (Hons) Programme at UniSZA” and decided that provisional recognition be accorded to the said programme and holders of UniSZA’s LLB (Hons) degree are required to sit and pass all five (5) papers in the CLP Examination in order to be a “qualified person” under Act 166. This provisional recognition is subjected to a review to be conducted by a Review Committee to be established by the LPQB two (2) years from the date of LPQB’s decision. In addition, UniSZA is required to submit regular reports to LPQB, until the Review Visit is conducted, on the extent of compliance with several conditions imposed by the LPQB.
An Evaluation Visit commissioned by the LPQB will take place from 17 – 20 November 2013 in order to determine whether the holders of the Bachelor of Syariah and Law (Hons) degree, Universiti Sains Islam Malaysia (‘USIM’), Nilai, Negeri Sembilan are to be exempted from the CLP Examination or otherwise. Following the visit, the Evaluation Committee will study the findings and recommendations by the Subject Evaluators and prepare a report containing the final recommendations for the consideration and decision of the LPQB.
Any enquiries regarding the above–mentioned decisions of the LPQB can be addressed to the Dean of the Faculty of Law of the higher education provider concerned or to [email protected] .
Thank you.
