Acceptance of Terms and Conditions

The use of, and access to, the Malaysian Bar website and its associated services (hereinafter referred to as “Website”) are strictly subject to these terms and conditions (hereinafter referred to as “Terms and Conditions”).

Please read these Terms and Conditions carefully before you use the Website.  By accessing or using the Website, you agree to accept, and are bound by, the Terms and Conditions.  If you disagree with these Terms and Conditions, please immediately cease using the Website.

Content of the Website

The Malaysian Bar (including members of the Bar Council and the Malaysian Bar Secretariat, collectively referred to as “MB”) reserves the right, at its sole discretion, and without prior notice, to modify, suspend, withdraw, amend, maintain, and update or discontinue any part of the Website, including any services or content made available through it.

The content of the Website, including any output generated by the Chatbot service (as stated below), is intended for information purposes only and does not constitute legal advice or professional opinion on which any reliance should be placed.  You should take appropriate steps to verify any such information and obtain legal and/or professional advice where necessary.

Use of the Website

If you possess a user identification, a password or any other information as part of our security measures to access certain parts of the Website, you must manage such information as strictly confidential for your sole use and must not disclose it to any third party.  MB reserves the right to disable your user identification or password at any time, if in its opinion, you have breached, and failed to comply with any of the Terms and Conditions.

You agree that you shall not:

  • introduce viruses, trojans, worms, logic bombs or other similar material which is technologically harmful to the Website;
  • attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website; and
  • attack the Website via a denial-of-service or distributed denial-of-service attacks or any other form of technical attack, and/or otherwise misuse the Website in any unlawful or prohibited manner.

Any material downloaded or otherwise obtained through the Website is accessed entirely at your own risk.  To the fullest extent permissible by law, MB shall not be liable for any loss of data,  damage to software, computer systems or equipment, and/or any other loss or damage  arising out of or in connection with such use, whether or not such loss or damage is foreseeable and MB had been advised of the possibility of the same.

In the event of a breach of these Terms and Conditions, your right to use the Website shall cease immediately.

Chatbot Service

The Website includes a third-party generative artificial intelligence (“AI”)-powered chatbot service, implemented using Microsoft Copilot Studio and any associated Microsoft cloud infrastructure(s) (“Chatbot”).  The Chatbot responses are  provided solely for general information, to assist you in locating and summarising information published on the Website.  Any responses generated by the Chatbot does not constitute legal advice, legal opinion, legal representation, or any kind of professional consultation.  Use of the Chatbot does not create any solicitor-client relationship or substitute advice from a qualified Advocate and Solicitor of the High Court of Malaya.

Responses generated by the Chatbot may be inaccurate, incomplete, outdated, misleading, inappropriate, or stated with unwarranted certainty. MB does not guarantee the accuracy, completeness, reliability or timeliness of any information generated by the Chatbot.  Any reliance placed on such information is strictly at your own risk.  In the event of any inconsistencies between the Chatbot response and the published content of the Website, the published content shall prevail.  You acknowledge that you are responsible for evaluating the accuracy, completeness and suitability of any information generated by the Chatbot and for any decisions or actions taken in reliance upon it.

The Chatbot does not require the submission of personal data to provide its response.  By using the Chatbot, you agree that you will not submit any confidential, sensitive, privileged or personally identifiable information to the Chatbot, whether relating to yourself or any third party, and accept the risks associated with the processing of the information provided by a third-party infrastructure.  You acknowledge that your inputs and interactions within the Chatbot may be processed, recorded, stored and transmitted to a third-party or an affiliated service provider.  Such processing may occur for the purpose of operating, securing, monitoring, maintaining, supporting and improving the Chatbot and its related services.  You understand that MB does not control the internal data and privacy management system of such third parties, which are governed by their own applicable terms.

Provision and Processing of Data

By using the Website to provide any information, including personal information, you declare and confirm that you are authorised to supply such information, that the information is true and accurate to the best of your knowledge and belief, and that you accept full responsibility for all consequences that might arise from such provision of information.  You also agree to promptly update such information as and when necessary.

By using the Website, you consent that the information provided, including personal information, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of MB or any of MB’s third-party service providers for the purposes of maintenance of a database relating to the membership of the Malaysian Bar, research, audit and such ancillary functions and services as may be relevant or necessary for MB in carrying out its functions and purposes.

Warranties and Indemnity

By using the Website, you unconditionally warrant and undertake that you will not use the Website or any of its contents for any unlawful purpose or in breach of these Terms and Conditions.  You agree that you shall indemnify, defend and hold harmless MB from any and all claims, demands, losses, damages, costs and liabilities, including reasonable solicitors’ fees arising out of or in connection with your breach of these Terms and Conditions, your acts, omissions or misuse of the Website, your submission, posting or transmission of any materials on the Website.

MB’s Liability

MB makes no representations or warranties as to the accuracy of the information contained on the Website.  To the fullest extent permitted by law, MB expressly excludes all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

MB shall not be liable for any direct, indirect or consequential loss or damage incurred arising from any reliance placed on materials or information posted on the Website, or from the use or inability to use the Website, or resulting from inaccuracies, defects, errors, whether typographical or otherwise, omissions, out-of-date information or otherwise, of information from the Website.  Such loss or damage includes, without limitation, loss of profits, income, business, goodwill, reputation, data, contracts, anticipated savings, management time or opportunity, whether foreseeable or otherwise.

MB shall not be liable for any third party websites that may be accessed through the Website or for any loss or damage that may arise from your use of them.  MB does not endorse or approve the contents of any such website and these links are provided for your information only.

MB shall not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on them, or on any website linked to them.

Intellectual Property Rights

All intellectual property rights in the text, graphics, information, motifs, logos, designs and databases contained in the Website including the domain names, arrangement and layout of the Website and the software used in relation to the Website are owned by MB or its licensors.

MB owns registered trademarks including but not limited to “Malaysian Bar”, “Badan Peguam Malaysia” and “Bar Malaysia”.  You may not use any trademarks, service marks and/or other trade names belonging to MB without MB’s prior written permission, including to suggest association with or endorsement by MB of your website and/or goods and/or services and/or business or otherwise.

All other trademarks on the Website belong to their respective owners and you will require their permission should you wish to use any such trademarks.

In the event any part of the Website is printed, downloaded or otherwise used or processed, you must acknowledge MB and the Website as the source of the information.  You are not permitted to amend the content of any of the materials and you shall not use any graphics, illustrations or photographs separately from any accompanying text.  MB reserves the right to revoke this permission at any time without notice.

You are not permitted to reproduce or incorporate any part of the Website or information found on the Website in any other work without MB’s prior written permission.

It is not permitted to use the Website for commercial use (other than as expressly permitted by MB) without prior written permission from MB. These Terms and Conditions comprise the entire agreement between MB and you, and supersedes all other agreements or understandings with respect to the subject matter herein.  These Terms and Conditions are subject to revision from time to time, which shall take effect immediately upon the posting of the modified terms and conditions, and thereafter references herein to “Terms and Conditions” shall include such modified terms and conditions.  You agree to check this page every time you visit the Website for any update, as you are bound by these Terms and Conditions.  If any of the modified Terms and Conditions is unacceptable to you, you must discontinue accessing the Website.  You shall be deemed to have accepted the revised Terms and Conditions without any reservation upon your use of, and access to, the Website following the posting of such modified Terms and Conditions.

General

If any provision of these Terms and Conditions is found to be invalid or unenforceable by any court of competent jurisdiction, the invalidity or unenforceability of that provision shall not affect the remaining provisions which shall remain in full force and effect.

No failure or delay by MB in exercising its right under these Terms and Conditions, statute, common law or the law of equity shall constitute a waiver of any such right unless expressly confirmed in writing.

Any dispute or claim arising out of, or in connection with, these Terms and Conditions and the use of the Website shall be governed by, and construed in accordance with, the laws of Malaysia.
