Temiar Orang Asli Trio Acquitted for an Offence under Section 148 of the Penal Code 18 Jan 2016 12:00 am

On 26 Feb 2014, three Orang Asli Temiar namely Anjang Itam, Rahman Uda and Anis Akai from Pos Lojing, Gua Musang, Kelantan, were confronted and attacked by more than 50 Myanmar migrant workers while on their way to a meeting at a nearby Orang Asli village.  Ironically, the land occupied by the farm where the migrant workers are located used to be an Orang Asli village and their land.  The Orang Asli have to pass through this farm in order to get to the other village.  The three victims suffered bodily injury and were hospitalised as a result of the attack. 

The Orang Asli victims lodged a police report regarding the incident, but the police advised them to accept a sum of RM500 each from the employer of the migrant worker, to settle the matter.  According to the Orang Asli, they were told to alter their statement and treat their injuries as an accident. Unhappy with the treatment given by the police, the Orang Asli lodged a complaint at the Police Headquarters in Bukit Aman with the assistance of the Bar Council, and in their report, complained against the unprofessionalism of the Gua Musang police for their biased treatment against them.

On 8 Mar 2014, which was the next day after they had lodged their complaint at Bukit Aman, Anjang Itam, Rahman Uda and Anis Akai were picked up by a police truck on the pretext of taking down their statements at the Gua Musang Police Station.  They were, however, detained and remanded at the police lock–up for investigation under section 148 of the Penal Code, which relates to possession of weapons during a riot.  
 
On 11 Mar 2014, the three Orang Asli were charged at the Gua Musang Magistrates’ Court under section 148 of the Penal Code, to which they claimed trial.  Bail was set at RM2,000 each person with one surety.  Sitti Zainah bt Zainal of the Bar Council Legal Aid Centre (Kelantan) assisted and represented the Orang Asli during the bail application.  

On 5 Oct 2015, they were ordered to enter their defence.  The defence was that all the three Orang Asli had been assaulted and critically injured by a mob while traversing over private land to a community meeting to discuss Orang Asli issues, including ancestral land rights.

The defence lawyers involved in this case were Suzana Norlihan, Roger Chan Weng Keng and Siti Zabedah Kasim.

After a trial for more than a year, the Gua Musang Magistrates’ Court decided in favour of the Orang Asli.  All three were acquitted and discharged on 15 Dec 2015.

The prosecution has appealed to the High Court against the decision.

Pada 26 Februari 2014, tiga Orang Asli daripada suku Temiar iaitu Anjang Itam, Rahman Uda dan Anis Akai dari Pos Lojing, Gua Musang, Kelantan, telah diserang oleh lebih daripada 50 pekerja warga Myanmar ketika dalam perjalanan ke suatu mesyuarat di kampung Orang Asli yang berhampiran. Secara ironi, tanah ladang yang diduduki oleh para pekerja warga asing ini dahulunya adalah tanah dan kawasan perkampungan Orang Asli.  Penduduk Orang Asli ini perlu melalui ladang ini untuk sampai ke kampung lain.  Akibat dari serangan itu, ketiga–tiga mangsa Orang Asli tersebut mengalami kecederaan anggota badan dan dimasukkan ke hospital.

Orang Asli tersebut telah membuat laporan polis mengenai kejadian itu, namun dinasihati pihak polis untuk menerima wang berjumlah RM500 setiap seorang daripada majikan para pekerja asing untuk menyelesaikan perkara itu.  Menurut Orang Asli tersebut, mereka diminta untuk mengubah kenyataan mereka dan menganggap kecederaan mereka sebagai suatu kemalangan.  Atas sebab tidak berpuas hati dengan layanan yang diberikan oleh pihak polis, Orang Asli tersebut telah membuat aduan di Ibu Pejabat Polis Bukit Aman dengan bantuan daripada Majlis Peguam.  Dalam laporan polis mereka, mereka mengadu tentang sikap tidak profesional pihak polis di Gua Musang dan layanan berat sebelah terhadap mereka.

Pada hari berikutnya iaitu pada 8 Mac 2014, Anjang Itam, Rahman Uda dan Anis Akai telah ditahan oleh sebuah trak polis atas alasan untuk mengambil kenyataan mereka di Balai Polis Gua Musang. Namun demikian, mereka telah ditahan dan direman di lokap polis untuk siasatan di bawah seksyen 148 Kanun Keseksaan yang membawa kepada kesalahan memiliki senjata semasa rusuhan. 

Pada 11 Mac 2014, ketiga–tiga Orang Asli tersebut telah didakwa di Mahkamah Majistret Gua Musang di bawah seksyen 148 Kanun Keseksaan, dan mereka mengaku tidak bersalah atas tuduhan tersebut. Wang ikat jamin telah ditetapkan pada RM2,000 setiap orang dengan seorang penjamin.  Sitti Zainah bt Zainal dari Pusat Bantuan Guaman (Kelantan) Majlis Peguam telah membantu dan mewakili Orang Asli tersebut semasa permohonan ikat jamin.

Pada 5 Oktober 2015, mereka telah diperintahkan untuk membela diri.  Pembelaan yang dikemukakan adalah bahawa ketiga–tiga Orang Asli tersebut telah diserang dan mengalami kecederaan yang parah oleh perusuh ketika menyeberangi tanah persendirian untuk menghadiri suatu mesyuarat komuniti untuk membincangkan isu–isu berkenaan masyarakat Orang Asli, termasuk hak–hak tanah adat.

Peguam–peguam yang terlibat dalam kes ini ialah Suzana Norlihan, Roger Chan Weng Keng, dan Siti Zabedah Kasim.

Selepas perbicaraan selama lebih setahun, Mahkamah Majistret Gua Musang telah mengambil keputusan yang memihak kepada Orang Asli tersebut.  Ketiga–tiga mereka telah dibebaskan pada 15 Disember 2015.

Pihak pendakwaan telah memfailkan rayuan kepada Mahkamah Tinggi atas keputusan tersebut.
