The Conveyancing Practice Committee (“CPC”) showed up in full force for its first meeting for the 2010/2011 term on 18 June 2010.  A majority of its long-standing members renewed their commitment to serve CPC for another term.  Abdul Murad b Che Chik was appointed as the new Chairperson, supported by Low Beng Choo as Deputy Chairperson.

CPC continues to work closely with property industry stakeholders, relevant ministries and government agencies.  Just prior to the end of the 2009/2010 term, members of CPC met with Malaysian Institute Estate Agents to discuss matters of common interest on 5 Mar 2010.  Property agents are frontliners who close the deal before the matter comes to the attention of solicitors.  During the session, CPC briefed the property agents on the role of solicitors in real property transactions.  Other important issues discussed related to the letters of intent/offer, which are commonly prepared by the agents, and the 5% service tax paid to an agent with payment of 2% earnest deposit.

On 2 July 2010, members of CPC and representatives from state bars held a dialogue session with officers from the Tax Operations Department of Lembaga Hasil Dalam Negeri (“LHDN”).  The meeting was to discuss the amendments to the Real Property Gains Tax Act (“RPGT Act”), which came into force on 1 Jan 2010, and Garis Panduan Cukai Keuntungan Harta Tanah, issued by LHDN on 2 Feb 2010.

For the first half of 2010, CPC attended several meetings with Jabatan Ketua Pengarah Tanah & Galian and the Ministry of Housing and Local Government to discuss:

(1)    the proposed amendments to the Building and Common Property (Maintenance & Management) Act 2007 (Act 663);

(2)    the proposed implementation of a standard checklist for registration of dealings in properties throughout Peninsular Malaysia; and

(3)    the proposed amendments to relevant legislation to implement the systematic issuance of strata titles together with vacant possession for newly-completed stratified buildings in the immediate future.

CPC is also closely monitoring the implementation of e-Adjudication and Stamps Assessment and Payment System (“STAMPS”) by the Stamp Duty Division of LHDN.
