PENANG: Lawyer Darshan Singh Khaira, 59, has been declared a bankrupt by the High Court for non–payment of costs plus interest amounting to RM123,902.33.
Senior assistant registrar Noor Fazila Ishak allowed yesterday the petition of the Penang Sports Club which was filed through the club's honorary secretary Albert Wong on April 24, 2005.
The order was made in the presence of Darshan Singh, the club’s counsel Surinder Singh and Insolvency Department officer Noor Hidayah Shaari.
On March 31, 2001, a High Court in Taiping ordered Darshan Singh to pay the sum as costs, plus interest, after it dismissed his suit against the club for disciplinary action over a fight on March 26, 1994.
Darshan Singh had filed several court actions from 1993 in Penang, Taiping and Alor Star against the club and various office bearers.
On Aug 14, 2003, Darshan Singh was declared bankrupt by another senior assistant registrar in Penang resulting from one of these cases.
He obtained a stay of this bankruptcy order and his appeal is pending at the Court of Appeal.
On Sept 9, 2005, the Taiping High Court ordered Darshan Singh to refund the club RM133,633.36 which it paid him after a writ of seizure and sales was wrongfully executed. This case is still pending.
