Thirty-five candidates have filed nomination papers for election to the Bar Council for the 2020/2021 term, pursuant to section 49 of the Legal Profession Act 1976. The deadline for submission of nomination papers was 31 Oct 2019.

"Alex has been an active member of the Bar and has contributed to the Bar in numerous capacities over the years since he was called to the Malaysian Bar in 1993. He was involved in assisting senior counsel like Raja Aziz Addruse in several cases involving the Bar in the tumultuous years between late 1990s to early 2000s, when the Bar faced many challenges from the government of the day. Alex was also involved in the Bar Council legal teams that represented those accused of "rioting" in 1997/98 during "Reformasi". Alex continues to act for and advise the Bar Council and the Bar in legal and other proceedings until today. He was also a member of a Special Committee of the Bar Council formed in 2003 to present a motion at an EGM of the Bar on the appointment and promotion of judges. Alex was also involved in the VK Lingam Royal Commission acting for the complainant and worked in tandem with the Bar Council in the proceedings. Alex has served as a member of the Disciplinary Board for 2 terms (4 years) from 2011 to 2015. Alex also served in the Sports Committee of the Bar Council for several years as the convenor for cricket. Alex has always shown his utmost commitment to the Bar and its ideals.
I have no doubt that Alex would be an asset to the Bar Council. I believe that he has the courage and fortitude to always act and voice his opinion without fear or favour. For these reasons, I have no hesitation in proposing Alex De Silva for membership to the Bar Council."

Anand firmly believes that in today's Malaysia Baru it is imperative that the Bar should stand steadfast in the protection of rights and have its voice heard loudly, clearly and regularly and should not be silenced nor drowned out in a cacophony of discordant noises nor shy away from striking a dissentient chord if justice demands it.
Anand studied at ATC, obtaining his law degree from the University of London in 1994 and has been in active practice since 1996. Anand taught students sitting for the London External LLB for 6 academic years over 1994 - 2000. He taught UK Constitutional Law and Public International law, with a focus on human rights.
Anand's practice has largely focused on tax disputes and, since 2011, competition law and antitrust advisory and investigation work. Over the years he has also undertaken corporate and commercial work, inbound investment work, joint ventures, sports law and oil and gas matters.
Anand's practice has him regularly in court against the Revenue, Customs, the Minister of Finance, Minister of International Trade and Industry and the Government of Malaysia.
Anand believes that the creation of a strong and robust Tax Bar is critical in defending taxpayers against the excesses of the authorities. To this end, Anand has served the Malaysian Bar pro bono in various capacities including in regularly conducting numerous training sessions for members of the Bar.
Anand acted as Counsel in the income tax case taken against the Malaysian Bar by the Revenue (1998 - 2009) and in obtaining the consequent refunds of taxes and costs from the Revenue. He was a member of the Bar's Ad Hoc Committee on the Recognition of Income for Tax Purposes (2008 - 2010) and also acted as Counsel in the Malaysian Bar's test case for the tax treatment of PII (2011 - 2017).
Since 2017 he has again acted as Counsel for the Malaysian Bar in its on-going case against the Revenue on the issue of legal professional privilege and regularly advises and acts for the Bar on other matters relating to tax and competition law.

Andrew is currently Co-Chair of the Constitutional Law Committee, where he is helping to broaden constitutional literacy. He was Chair/Co-Chair of the Human Rights Committee from March 2009 to March 2018. He is also a member of the Committee on Orang Asli Rights, Committee on the Rights of the Child, Migrants Refugees and Immigration Affairs Committee, and the Task Force for an Independent Police Complaints and Misconduct Commission and Police Accountability.
He is concurrently Co-Chair of the Trade in Legal Services Committee, working to enable the Bar to respond to calls for the opening-up of the legal profession, safeguarding our liberalisation framework and managing the entry of foreign lawyers to ensure they contribute positively to the overall growth and development of the legal services market in Malaysia. He is an ad-hoc member of the Selection Committee that considers applications from foreign law firms and foreign lawyers to practise in Malaysia, and from local law firms seeking to employ foreign lawyers.
Andrew is also Co-Deputy Chair of the Legal Profession Committee, which looks into regulatory compliance and professional practice issues and queries.
In September 2019 Andrew was appointed to the government's Special Committee to study Proposals for Alternative Sentencing to the Mandatory Death Penalty. The work of the Special Committee is on-going.
Andrew is a frequent speaker and writer on behalf of the Malaysian Bar, contributing to the conversation on human rights, fundamental liberties and constitutional law in the public sphere both at home and abroad. He has also acted pro-bono for the Malaysian Bar and SUHAKAM in watching briefs relating to fundamental liberties, constitutional law and elections and allegations of enforced disappearances.

We, the undersigned, hereby nominate Mr Arunachalam s/o Kasi for the Election to the Bar Council 2020/2021.
Mr. Arun Kasi graduated in law in 1994 when he was only 19 years old. He pursued his law studies largely on his own from his home as he did for most part of his secondary education. He holds a Masters' degree in law from the University of Malaya and graduated with distinction. He is also an arbitrator (Fellow of CIArb, London).
He is a prolific writer in law and in 2014 he has written a book on Arbitration. Recently, he has co-authored and revised 3 of the JANAB Law Series' books, namely Civil Procedure, Evidence and Conveyancing Practice. He has written more than 20 articles in law, published locally and internationally, on diverse subjects on the law including on arbitration, judicial review, medical negligence, etc. He has also co-authored the concept paper on University cum Court Annexed Arbitration Scheme. He is remembered for his writings in the Bar's Lawyers Talk group.
He has given talks on diverse law subjects at universities, Bar committees, public symposiums, government agencies, etc. He had boldly stood up on various legal issues and expressed his view, etc.
His skills are not limited to law, but extends to IT. He started programming software at a young age of 12 and developed his skills in later years for the benefit members of the Bar by writing extensively on conveyancing software known as ELM Conveyancing Module.
One of his greatest contribution to the Bar is moving a resolution at the Bar AGM to reduce e-filing subscription from approximately RM1,800.00 for two years. Arising from his earlier research and knowledge in IT software, he was able to present his resolution and gain the support of Bar. As a result of his stupendous act, the e-filing system subscription was reduced by almost 90%. The charges are now about RM180 for two years. His action must be commended as it has helped the members of the Bar as a whole.

(5) COLLIN ARVIND ANDREW
We are very proud to be able to propose Collin Arvind Andrew as a candidate for the Bar Council elections for the term 2020/21.
With all three of us having been former Chairperson of the Bar Council Legal Aid Centre (Kuala Lumpur) ("KLLAC"), we have intimate knowledge of Collin's aptitude, dedication and integrity towards his work at KLLAC. We can attest to this fact from the days where he was a pupil in chambers in 2010 until he was elected to the position of Chairperson for three (3) terms now. Collin has shown a steep growth at KLLAC, both at operational and management level.
Whilst serving as a Chairperson of the KLLAC, Collin spearheaded a Refugee & Asylum Seekers Legal Aid Scheme ('RALAS') together with UNHCR Malaysia to assist refugees and asylum seekers in the country. Parallel to RALAS, Collin has also spearheaded a legal aid scheme to assist foreign nationals who need legal assistance. He did so by engaging with the various embassies. Collin is also a regular trainer of the YBGK scheme, contributing his time for an effective legal aid scheme in the country.
We have no doubt that if elected, Collin will continue to serve and contribute towards the development of the Bar, as he has shown in advocating the cause of legal aid and the rule of law.

With all three of us having been former Chairperson of the Bar Council Legal Aid Centre (Kuala Lumpur) ("KLLAC"), we have intimate knowledge of Collin's aptitude, dedication and integrity towards his work at KLLAC. We can attest to this fact from the days where he was a pupil in chambers in 2010 until he was elected to the position of Chairperson for three (3) terms now. Collin has shown a steep growth at KLLAC, both at operational and management level.
Whilst serving as a Chairperson of the KLLAC, Collin spearheaded a Refugee & Asylum Seekers Legal Aid Scheme ('RALAS') together with UNHCR Malaysia to assist refugees and asylum seekers in the country. Parallel to RALAS, Collin has also spearheaded a legal aid scheme to assist foreign nationals who need legal assistance. He did so by engaging with the various embassies. Collin is also a regular trainer of the YBGK scheme, contributing his time for an effective legal aid scheme in the country.
We have no doubt that if elected, Collin will continue to serve and contribute towards the development of the Bar, as he has shown in advocating the cause of legal aid and the rule of law.

Farez is recognisable not only by his large frame (big tall guy), but also from his many appearances from doing very good work for the Bar. I was called to the Bar on 5 October 2006, and since completing the Master of Criminal Justice degree programme at University of Malaya in 2008, I have been practising on my own. In 2019, I have been empanelled with the Malaysian Mediation Centre as an accredited mediator.
I am honest, hardworking and, above all, have a strong desire to help people without any expectation in return. Despite the criticism, I accepted the brief to defend one Fatimah Abdullah, who was accused of severing her husband's penis at the Kuala Pilah Sessions Court. I constantly reminded myself the duty of a defence counsel, which is codified as rule 9 of the Legal Profession (Practice & Etiquette) Rules 1978, that is to say:
(a) an advocate and solicitor who undertakes the defence of a person in any criminal matter shall by all fair and honourable means present every defence that the law permits; and
(b) an advocate and solicitor shall undertake the defence of a person accused of an offence regardless of his personal opinion as to the guilt or otherwise of the accused.

Again, I received several criticisms from the public, especially on the social media, after accepting the brief to file the review application against the acquittal of Lim Guan Eng in the "Bungalow Case". Nevertheless, I kept reminding myself the message shared by the Malaysian Bar in its press release dated 15 March 2016, which says that there should be no usurpation of the judicial powers of the courts, as it is for the courts - and not the Attorney General - to decide on the innocence or guilt of a suspect in respect of any alleged crime.
I believe that I have the experience and passion required to serve the Malaysian Bar, and all I ask for is your kind support.

Dato' Sri Jahaberdeen or Jabar as he is known to his friends has been active in advancing social, national unity and human rights issues for years. He wears many hats and is ever willing to work with any group that promotes the general welfare of Malaysians without any partisan boundaries. Many have known him to be very consistent with his passion for the promotion of the humanistic face of Islam and his quest to encourage more "Raperas"- thinking and compassionate citizens.
He practices at Messrs Jahaberdeen & Co, and he has been active in the various Bar Council sub-committees over the years such the Human Rights Committee, the Syariah Law Committee and the Corporate and Conveyancing Law Committee.
He blogs his views on comparative religion and Islamic perspectives on his blog entitled "Journey To God" at http://jahamy.blogspot.com while he blogs his socio-political views on http://jahaberdeen.blogspot.com on his blog entitled "Rapera". He has travelled around the country delivering talks on "Human Beings born free and Equal from the Quranic Perspective".
He is a founder of the Rapera movement which embodies his decades of quest to encourage thinking and compassionate citizens in the country. He also the President of Yayasan Rapera which has the objective of nurturing thinking and compassionate citizens. In 2018, he has given talks in about 20 local Universities on the need for thinking and compassionate citizens for Nation building.
Apart from legal practice, he has been active in civil society for more than 20 years by being involved in various social and volunteer organizations. To name a few, he was an active Exco member of Just International movement, and Chairman of the Islamic Law transformation panel under Majlis Dakwah Negara.
In the sports arena, he is the President of Kuala Lumpur Badminton Association (KLBA) and Vice President of Badminton Association of Malaysia (BAM).
He has written two books called "Islam: Antara Isi dan Kulit" and "Rapera urgently wanted". He was a columnist with Berita Harian in the 1990s, Malay Mail and currently writes a column on Sunday at The Star.

R. Jayabalan graduated with LL.B (Hons) from the International Islamic University Malaysia (IIUM) in 1996. He was admitted to the Malaysian Bar in 1997. After that he also completed his MBA in IIUM in 2004.
Jaya has been in active practice since 1997 and is based in Johor Bahru. He started as a legal assistant before entering into a partnership. In September 2013 he set up his sole-proprietorship practice. His area of practice is mainly general civil litigation comprising areas such as tort, commercial, construction, industrial relations and administrative law litigation at trial and appellate level.
Jaya has served at several sub-committees of the Johore Bar before he was elected as Chairman of the Johore Bar for 2018/2019 and also served as the Johore Bar Rep to the Bar Council. He is currently serving as the Chairman of the Bar Council Small Firms Practice Committee and Deputy Chair of the Professional Indemnity Insurance (PII) Committee.
Jaya is a strong advocate for the small firms. He believes that small firms being the largest stakeholders at the Bar should have more say and space in the policies of the Bar Council and in the future direction of the profession. The special needs and interests of the small firms require more attention from the Bar Council. There is a lot more that can be done by the Bar to improve the sustainability and competitiveness of small firms. Jaya has been actively advocating the cause of the small firms and exploring the means to improve small firms practice with the support of his passionate committee at the Small Firms Practice Committee. He aims to continue to push the agenda for small firms if elected to the Bar Council.
Jaya is a strong believer on the rejuvenation of the Bar through empowerment of the youth. Younger members should not be daunted by age, experience and seniority. Younger members should be brave and bold and step forward to lead the Bar. During his service as Chairman of the Johore Bar he had actively pursued young members to step forward to play an active role at the Bar and to take charge of the affairs of the Bar.
The Bar Council must continue to uphold the cause of justice and rule of law without fear or favour. These are challenging times for our country. The Bar Council must rise to the challenge and meet the expectations of the general public. If elected Jaya wishes to add to the strength of the Bar Council in facing the adversities and obstacles in upholding the rule of law and the cause of justice.
There is huge expectation amongst members for the Bar Council to remain relevant. For this the Bar Council should pay more attention to members' bread and butter issues. Mohamad Ezri Bin Abdul Wahab was called to the Bar in 1994.

1. Amir graduated from International Islamic University Malaysia, Master of Comparative Laws, and post-graduated Diploma in Syariah and Legal practice from the same university.
2. Amir's area of practice covers mainly Islamic Estate Planning (including Wasiyyah and Hibah), Islamic Family Law , Islamic Estate Distribution, Legal Training and Mediation .
3. Amir is very active in giving talk for the past three years organised by the Malaysian Bar and all State Bars, both in the West Malaysia and Borneo Malaysia. Amir is also an active speaker in Mosques and Surau in Federal Territories, Selangor and Sabah (150 speaking engagements).
4. Amir practices in three jurisdictions namely the Civil Court and the Syariah Court in the state of Federal Territory and Selangor.
5. Amir Bahari was a member of KL Bar Committee from the year 2013/2015 as the Conveyancing Chair for the Corporate and Conveyancing Practice Committee for the KL Bar Committee.
6. Amir is a certified trainer under MIM - PSMB and a Master Class Trainer from Billy Kueek International.
7. To date he has written 5 books namely on Islamic Will (published by Telaga Biru) and Islamic Estate, Retirement and Waqf Planning (published by IBFIM).

(20) MUHAMMAD RAFIQUE BIN RASHID ALI (MUHAMMAD RAFIQUE)
RAFIQUE (MUHAMMAD RAFIQUE BIN RASHID ALI)
Rafique was called to the Bar on 16.05.2002 after completing his pupillage in the chambers of the revered SS Muker. A graduate of the International Islamic University Malaysia, Rafique was destined to not only read law but to take on the footsteps of his late father Rashid Ali Sickander, himself a fellow lawyer.
Rafique was a Selangor Bar Committee member since 2015, and actively held the Chairperson of Selangor Bar Sports Committee. He is running again for Council after making his debut from the floor and getting elected.
Since his early days in practice till now, he has been actively involved in Selangor Bar football team, and under his stewardship, Selangor Bar became overall champion in the inter-state Bar Sport Championship in 2015. He is also an active hockey player who wears the Malaysian Bar Hockey jersey with pride. He also plays football for the Bar Vets team as well as social league obligations for both the Selangor and Malaysian Bar football teams.
He practices Criminal law, and public litigation and speaks frequently on this subject. He is also an active Selangor Bar Criminal Law Sub-Committee member. On many areas of criminal and constitutional law practice, Rafique speaks without fear or favor.
Invariably, Rafique's talent does not stop on the field, he is a regular feature in compering and acts as Master of Ceremony in official and social functions of the State Bar. He is also heavily involved in most of the activities in the Bar Council and/or Selangor Bar Committee. He is also a Trainer in Criminal Advocacy Training Course for members of the Bar.
Currently he is an active member of the Bar Council and holds the following posts:
i) Co-Chairperson of the Sports Committee;
ii) Co-Chairperson of the IPCMC Committee; AND
iii) Deputy Chairperson of the Criminal Law Committee.
Rafique is currently involved in the Criminal Law and Criminal Procedure classes for "Special Module for Skills and Practical Training" in USIM to assists its Faculty of Law in achieving full accreditation for Bachelor of Law and Syariah (LL. B_S Hons.).
We have had the pleasure of knowing and watching Rafique at close quarters and we verily believe he has much to offer to the Bar. Young and energetic, he should be an asset to the future of the Bar.
