#MansuhAktaHasutan

On 20 Jan 2016, the Bar Council National Young Lawyers Committee (“NYLC”) organised a workshop for young lawyers, on the Sedition Act 1948.  The purpose of the workshop was to educate Members of the Bar on the practical aspects of handling cases under the Sedition Act 1948, and to focus on the relevant case law relating to sedition.

The workshop was held as part of NYLC’s “#MansuhAktaHasutan” campaign as well as the resolution adopted at the Extraordinary General Meeting of the Malaysian Bar held on 19 Sept 2014.

Approximately 15 participants — comprising Members of the Malaysian Bar, pupils in chambers and law students — attended the workshop.  The Co–Chairperson of NYLC, Syahredzan Johan, conducted the workshop.

The workshop covered, among others, the following aspects of the Sedition Act 1948:

  •  The definition of “sedition”;
  •  What constitutes “seditious tendency”;
  •  The weaknesses of the Sedition Act 1948;
  •  Practical aspects in defending a person investigated or charged with sedition; and
  •  The recent amendments to the Sedition Act 1948 by the Malaysian Parliament.

  • The workshop ended with a question–and–answer session.
