SRO Enforcement team visits Pahang firm PDF Print E-mail

The No Discount RuleOn January 12, a team of members from the Solicitors Remuneration Enforcement Committee (SREC) visited a legal firm in Kuantan, Pahang to verify the information contained in the legal firm’s return for 2005 transactions. The partners of the firm gave their full cooperation by furnishing explanation and further documentary evidence of the reported transactions which were required by the team of enforcers.

A scheduled visit to another legal firm in Kuantan on January 11 was postponed at the last minute as the firm had written in to state that their conveyancing partner was overseas.

In conjunction with the enforcement visit, members of the SREC gave a talk on “SRO Enforcement”, organised by the Pahang Bar Committee. The talk was held on January 12 at the Pahang Bar Building in Kuantan. The SREC was represented by Tony Woon (Bar Councillor from Negeri Sembilan), Asmadi Awang (Bar Councillor from Terengganu) and Andrew Wong.

The talk was chaired by Sazali Abdul Aziz, Chairman of the Pahang Bar and about 30 members of the Pahang Bar attended. There was a lively discussion on what a solicitor may or may not charge as disbursements and on how to charge fees for certain transactions. It appeared that many members of the Pahang Bar are not well versed with the SRO 2005 despite the many circulars sent out by the Bar Council on conveyancing practice.

Meanwhile, when contacted, Roger Tan, the Chairman of the SREC, announced that the SREC will be making visits to legal firms in 2 other states in February and March 2007.

"The SREC will also continue to request the solicitor in charge of the transactions reported in their respective firm’s return, to attend personally, if necessary, before the SREC to provide further information on their reported transactions", said Tan.
