IPOH: A team of 4 members from the Solicitors Remuneration Enforcement
Committee (SREC) visited 2 legal firms in Ipoh on Saturday, March 10 to verify
information contained in the firms' Returns for 2005 and 2006 transactions.
The team was led by the SREC Deputy Chairman Ong Siew Wan, who was assisted by
Haji Abdul Murad B Che Chik, Seah Chin Lee and Sally Chee Lai Yan of the
Selangor Bar.
The solicitors in charge gave their full cooperation by
furnishing further documents and explanation required by the team.
However, some of the explanation given was far from satisfactory as the
solicitors were not able to explain the existence and non-existence of certain
documents in the files. Similarly, the solicitors were questioned why all cash collections from the clients were treated as petty cash.
The team will now submit its report to the SREC at its next meeting to decide on
the next course of action.
When contacted, the Chairman of SREC, Roger Tan said members should stop
attempting to alter, fabricate or remove documents which can be viewed as an intent to mislead
the enforcement team, and such an act will be viewed more seriously than the act of giving
discounts and overcharging.
Tan added that during the last visit to Penang firms, it was
discovered that some firms charged one set of fees for the Transfer and another
set for the sale and purchase agreement. This is not allowed as the SPA and the
Instrument of Transfer are part and parcel of the same transaction. Tan revealed
that the SREC in its meeting last Friday has also decided to return to Penang,
and it is expected to visit about 10 other firms there.
Tan also announced that the next visit to Kelantan will involve 4 law firms.
