Solicitor fined RM10,000 for failing to file SRO return

On September 7, 2007, Jefrizal Bin Mohd Jaafar of M/s Jefrizal & Co (Klang), was
fined RM10,000 by the Disciplinary Board for breach of Rule 4(1)(a) of the
Solicitors’ Remuneration (Enforcement) Rules 2004.
The said Rule 4(1)(a) requires a solicitor, upon receipt of a notice from the
Bar Council, to complete and deliver to the Bar Council within a time specified
in the notice, a return relating to transactions for a period specified in the
notice.
To date, complaints against solicitors from 640 legal firms who have failed to
file their returns have been lodged or are in the process of being lodged with
the Disciplinary Board.
Many solicitors have been directed by the Enforcement Committee to refund to
their clients disbursements which have been overcharged by the solicitors and to
show proof that they have done so, failing which they shall be referred for
disciplinary action.
In respect of complaints relating to non-compliance of the SRO:
(a) The following solicitors have been fined by the Disciplinary Board:
Dang Lee Boon of M/s Ajmer, Sandhu & Ong (KL) (RM5,000).
Norita bt Dato’ Abdullah of M/s Abdullah, Abd Rahman & Co (KL)(RM2,000).
Zamzuri bin Hj Mohd Yatim of M/s KK Lim & Associates (Batu Pahat)(RM5,000).
(b) The following solicitors have been reprimanded by the Disciplinary Board:
Zahran bin Abdullah of M/s GH Lim Zahran & Partners (Kota Bharu).
Lee Mei Yeng of M/s Tan & Lee (Johor Bahru).
(c) Complaints against four solicitors from three legal firms have been
dismissed by the Disciplinary Board.
(d) 16 complaints are at various stages of investigation by the Disciplinary
Board and 30 complaints are in the process of being lodged by the Bar Council’s
Complaints Department with the Board.
