DB will take SRO breaches more seriously from now on

KUALA LUMPUR, Fri (April 25): The Chairman of the Advocates and Solicitors
Disciplinary Board (DB), Tan Sri Dato’ Seri Khalid Ahmad bin Sulaiman today
said the DB will now take a more serious view of any breaches of the no-discount
rule or the Solicitors Remuneration Order because it is unfair and unjust to
honest lawyers who abide by the rule.
Tan Sri Khalid said this in his opening address at the dialogue session
organised by the DB at the Bar Council Auditorium.
The dialogue was held to give an overview of the functions of the DB as well
as getting feedback and comments from members on possible improvement on the
DB's operations.
Also present were Dato’ Dr. Cyrus V Das, Chairman of DB's Legal Committee,
Mah Weng Kwai , Chairman of DB's Admin-Finance Committee and Dato’ V L
Kandan, Chairman of DB's Publications Committee.

After years of debate and attempts to enforce the NDR (no discount rule) could any council member / the relevant committee member/s confirm in no uncertain terms that the enforcement has been effective? How many conveyancing practitioners can honestly declare that no discount has ever been given by their firms since the coming into force of the NDR?
Whilst many conveyancing practitioners are all for the NDR (why not? we make more money), it is unfortunate that the obedient law abiding members keep losing clients to 'discount lawyers'. How long can one survive on 'principle'? How would our Bar address such issue? Does our Bar expect members to live below their means or look for another job (or moonlighting) whilst they figure out what to do with conveyancing practitioners' livelihood?
Why are conveyancing practitioners placed in such dilemma whilst litigation/corporate lawyers are free to charge any fee they deem fit? Are we all not equal before the law? Why the discrimination and double standard?
