Bar welcomes HLBB’s re-affirmation to follow SRO 2005

KUALA LUMPUR: Chairman of the SRO Enforcement Committee, Roger Tan today said the Bar welcomes the latest response from a branch of Hong Leong Bank Berhad (HLBB) in reaffirming that they would follow the scale fees as laid down in the Solicitors Remuneration Order 2005.
The response came about after the Committee received a letter from a firm of solicitors enclosing a letter of instructions from the Ipoh Mortgage and Collection Centre of HLBB that the latter had instructed that for Zero Cost Loan, HLBB would only pay legal/professional fees according to the SRO 2005 but subject to a maximum of RM20,000.00.
The Bar Council subsequently wrote to HLBB seeking clarification on such instructions. In its letter dated September 11, 2006 and copied to the Bank Negara and CEO of HLBB, the Centre said they would "wish to reaffirm that we are following the Solicitors' Remuneration Order in respect of fees and disbursements and disbursements for all conveyancing fees". This is also in line with HLBB's earlier stance as stated in their letterdated September 7 last year that they would abide by the SRO in respect of fees and disbursements.
In a circular issued to members today, Tan said should any member encounter any difficulty with any financial institution in his compliance with the SRO, the member should inform the Committee to enable the Committee to take the appropriate action.
