Rule 5. Production and delivery of further documents
(1) For the purposes of verifying whether any information furnished to the Bar Council in accordance with Rule 4(1) hereof is accurate, correct, complete or otherwise; the Bar Council may by written notice require an advocate and solicitor to produce and deliver to the Bar Council (or to any person appointed by the Bar Council), at a time and place stipulated in the said notice, any further or other documents (original or otherwise) relating to the transactions, as the Bar Council may deem fit. The Bar Council may inspect, examine, copy or make extracts from any such documents; or require the advocate and solicitor to supply (at his own costs) copies of or extracts from such documents.
(2) The Bar Council may take possession of any documents (original or otherwise) required to be furnished under Rule 5(1), where in its opinion: -
(a) the inspection or examination of them, the copying of them or the making of extracts from them cannot reasonably be undertaken without taking possession of them; or
(b) they may be interfered with or destroyed unless the Bar Council takes possession of them; or
(c) they may be needed as evidence in any disciplinary proceedings instituted or to be instituted against the advocate and solicitor concerned.
(3) A report containing the findings of the Bar Council made under this Rule may be used as a basis for a complaint to the Disciplinary Board against the advocate and solicitor concerned.
