Rule 4. Submission of returns and production of documents
(1) For the purposes of obtaining full information for ascertaining whether or not an advocate and solicitor has complied with the Solicitors' Remuneration Order or any rules or rulings of the Bar Council relating to the Solicitors' Remuneration Order, the Bar Council, acting on its own motion or upon receipt of information or complaint by a third party, may by notice require any advocate and solicitor: -
(a) to complete and deliver to the Bar Council within a time specified in the notice (not being less than thirty days from the date of service of the notice), a return relating to the transactions for the period or periods specified in the notice; and/or
(b) to attend personally before the Bar Council and produce for examination any documents relating to the transactions; and/or
(c) to provide in writing such information or particulars which the Bar Council deems necessary.
(2) The notice to make a return in accordance with Rule 4(1)(a) hereof shall be in Form A set out in the Schedule hereto or in a form to the like effect approved by the Bar Council from time to time.
(3) The return to be completed and delivered to the Bar Council in accordance with Rule 4(1)(a) hereof shall be in Form B set out in the Schedule hereto or in a form to the like effect approved by the Bar Council from time to time.
(4) A report containing the findings of the Bar Council: -
(a) on the return made in accordance with Rule 4(1)(a) hereof; or
(b) on an inspection in accordance with Rule 4(1)(b) hereof; or
(c) on any information or particulars furnished to the Bar Council in accordance with Rule 4(1)(c) hereof;
may be used as a basis for a complaint to the Disciplinary Board against the advocate and solicitor concerned.
