INTRODUCTION

The Bar Council is called upon from time to time to issue rules and rulings pertaining to the practice, conduct and etiquette of Advocates and Solicitors (collectively “Rulings”). These Rulings are generally made ad-hoc as a result of specific queries made by Advocates and Solicitors or members of the public.

However, though such Rulings may arise from specific queries, they often relate to matters of practice, which may recur from time to time. Hence the Bar Council is of the view that it would be in the interest of the legal profession as a whole to collate and compile these Rulings for ease of reference. However, the Rulings should not be taken to have exhaustively covered all situations that may arise in practice and the Bar Council may introduce new Rulings to revise, vary, add or revoke the same as and when it deems fit

Advocates and Solicitors and pupils should constantly bear in mind that they are expected to know and abide by inter alia the Legal Profession (Practice and Etiquette) Rules 1978 (“Etiquette Rules”), the Legal Profession (Publicity) Rules 2001 (“Publicity Rules”) and Rulings of the Bar Council.

The Rulings reproduced herein have also been revised and made to harmonise with the Publicity Rules 2001.

Members are reminded that the breach of any of the Rulings constitutes “misconduct” within the meaning of Section 94 of the Act [see Section 94(3)(k)] and may lead to disciplinary proceedings being taken against the Advocate and Solicitor concerned or his firm.

Members should write to the Bar Council for clarification in respect of any Rulings if necessary or in respect of any lacuna or perceived lacuna in the Rulings.

It is the earnest hope of the Bar Council that the compilation of the Rulings will assist members and lead to a better understanding of the relevant Rules pertaining to practice, conduct and etiquette for the greater good of the profession.
