The decision of the Federal Court today, 27 June 2001, allowing the appeal of Encik Zainur Zakaria, a past president of the Malaysian Bar, against his conviction for contempt of Court and the sentence of 3 months' imprisonment is most welcome and greeted overwhelmingly with joy by the Malaysian Bar and no doubt by the general Malaysian public as well.
The unanimous decision of the Federal Court not only vindicates Encik Zainur Zakaria of the offence of contempt of Court but also reinforces the principle that Advocates and Solicitors should act fearlessly to uphold the interest of their clients, the interest of justice and the dignity of the profession without regard to any unpleasant consequences to themselves.
The Federal Court also rightly dealt with some important principles of law on contempt of court and the procedure that ought to be correctly followed by the trial Court in contempt cases.
The Malaysian Bar wholly agrees with the Federal Court that for the proper administration of justice by the Courts, fairness is paramount. A person accused of an offence must be given every opportunity to prepare and present his best defence, lest it be said that justice hurried is justice buried.
The Federal Court's decision will most certainly help to enhance the public's confidence in the Judiciary and in the rule of law.
