The Bar Council welcomes the statement of the Attorney General Tan Sri Mohtar Abdullah which appeared in the New Straits Times on 30/5/99, reminding his Legal Officers, both at the Attorney General's Chambers as well as State Legal Adviser's Offices, to discharge their duties professionally and fairly and to prosecute cases without fear or favour.

Legal Officers must always remain apolitical and although they are civil servants answerable to the government of the day, they must never be seen to be taking sides in favour of the government or against accused persons.

The Bar Council agrees with the Attorney General that the focus of the people and international community is presently on the credibility of the legal and judicial institutions in this country. The legal and judicial officers should therefore be mindful of this and react in a positive manner to restore the confidence of the public and the international community in these two institutions.

Deputy Public Prosecutors are appointed by the Public Prosecutor (who is the Attorney General) under Section 376(iii) of the Criminal Procedure Code and may exercise all or any of the rights and power vested in or exercisable by the Public Prosecutor except such rights or powers expressed to be exercisable by the Public Prosecutor personally. As such all Deputy Public Prosecutors should at all times maintain the highest standards and ethics of prosecution.
