The Bar Council has received information that a group of persons, accompanied by 2 lawyers, had gone to the Brickfields Police Station at about noon today with the intention of lodging police reports and meeting with the OCPD in relation to the matter concerning the fate of one Francis Udayapan Their purpose had been made known to the police by way of a letter sent prior to the visit.

We are informed that these persons were met by the OCPD and FRU officers outside the main gate of that police station. They were asked to leave. When they insisted that they had the right to be there to lodge police reports, they were then told to wait outside the station and to go in one-by-one to lodge their reports.

The first person went in, accompanied by one of the lawyers, Mr. Surendran. While they were in the process of lodging a police report, the police ordered the persons waiting outside to disperse, and almost immediately moved in to arrest 11 of them. Among the persons arrested was the other lawyer present. Mr. Uthaya Kumar.

We are further informed that when Mr. Surendran approached the police and repeatedly enquired the reason for the arrest, no reason was given. At the time of writing this Press Statement, we are informed that the police has not given any information on the ground of arrest nor allowed any access to the detained persons.

On the information received, the Bar Council is shocked at the unprofessional and high-handed manner in which the police has handled the matter. There appears to be no credible or justifiable reason for the arrest of those persons, and certainly none has been forthcoming. In addition, the arrest of a lawyer in the course of the performance of his duty tantamounts to an interference with the legal process.

The Bar Council calls for the immediate release of the 11 arrested persons. They (and others) must be allowed to lodge police reports without interference or intimidation.

Dated this 30 April 2004

Chairman
Bar Council
