The Bar Council calls for the Report and Recommendations of the Royal Commission to be made public when submitted. The Bar Council believes there is too much public concern and outrage at the admission of assault made by the former IGP for the issues before the Commission to be treated as confidential and not for public disclosure. The public is entitled to know how something like this could have happened and what measures would be taken to prevent the recurrence of custodial violence. Ultimately the concern is for the common man.
The Bar Council notes that the Special Investigator Tan Sri Abu Talib had rightly addressed a larger question before the Royal Commission when he submitted “custodial violence or abuse of police powers has been a disturbing factor in this country…(we) have read time after time of custodial violence and abuse of police power” and that “ every right thinking member of society is concerned about it and (he) sincerely hope(s) action will be taken for its eradication”.
The Bar Council believes strongly that the issue of custodial violence is of vital concern to the public and calls on the Home Ministry to look into this question immediately in the public interest. A person is entitled to expect, when taken into custody, that he would not be ill-treated or subjected to any assault. This is fundamental in a country governed by a Constitution and the rule of law. If public confidence in the police force is to be restored, it falls on the Home Ministry to inform the public what measures are being introduced to prevent any recurrence of custodial violence. This must necessarily include a genuine mechanism to evaluate independently any complaint against the police force by a person taken in custody.
