The Bar Council refers to the statement by the Minister in the Prime Minister’s Department Datuk Seri Dr Rais Yatim as reported in the New Sunday Times on 22 September 2002 that the Government will conduct a thorough study on the recommendations of the Malaysian Human Rights Commission (Suhakam) pertaining to the Internal Security Act (ISA) before deciding whether there is a need to make any amendments to the legislation.
The Bar Council wishes to commend the Minister for his response. A review of preventive laws such as the ISA has been long overdue, and the Bar Council in fact has been consistent in its call for the repeal of the ISA and all other legislation that allows for preventive detention without trial. In March 1999, the Bar Council presented a Memorandum on the ISA to the Prime Minister Datuk Seri Dr Mahathir Mohamad detailing the views and recommendations of the Council.
The Bar Council urges the Minister to also consider the Memorandum of the Bar Council on the ISA as the view of the legal profession will be pertinent in any study of the legislation. The Bar Council would also be ready to assist at any time if further input is required.
