The Bar Council is concerned over recent news reports on the alleged failure of the police to provide protection to an eyewitness to a murder case despite 12 police reports he lodged complaining of threats by the suspected assailant against him.
The witness is an uncle of the eight year old girl who was allegedly raped on September 26 and brother-inlaw of her father, who was hacked to death by a group of assailants on October 24.
The police have a duty to protect members of the public from acts of criminal intimidation. In view of the escalating bravado and utter disrespect of the law and the criminal justice system on the part of the suspected assailants, the Bar Council calls upon the police to take reports of threats seriously before they lead to further loss of life.The police must take effective steps to bring the alleged perpetrators of the crime to justice speedily and afford all maximum protection to witnesses in view of the threats from the suspects. Further untoward incidents in relation to the case must be prevented at all costs before the public loses confidence in the police.
On a separate matter, the Bar Council had issued a statement on March 21, 2001 regarding the violent clashes which occurred at Kampung Medan in which five people were killed and others injured. The Bar Council had at that time called for an Independent Royal Commission of Inquiry to investigate the matter and determine the cause(s) of the problems that led to the sudden outburst of violence. To date, an independent Royal Commission oflnquiry to investigate the case has not been appointed.
The Bar Council therefore reiterates its call for a Royal Commission of Inquiry to investigate the matter. The Commission, when appointed, must move with all due speed to complete the inquiry and make public its findings and recommendations. The Bar Council also urges SUHAKAM to conduct a similar investigation of their own.
