PRESS STATEMENT: The I.S.A. Arrests PDF Print E-mail

Press StatementThe Bar Council deeply regrets the use by the Government of the ISA against the 5 named persons yesterday. The Bar Council has repeatedly voiced its vigorous opposition to the draconian Internal Security Act and generally to preventive detention laws all of which are inconsistent with the Rule of Law. The Bar Council calls for the release of the detainees or that they immediately be brought before a court of law and charged so that they may avail themselves of all the safeguards guaranteed by law to which they are entitled.

The Bar Council urges the Government to reconsider its position in this matter and to hold back on making any further arrests under the ISA.

The Bar Council once again reiterates its call to the Government for the immediate repeal of the Internal Security Act as the Act violates fundamental rights and is against the universally accepted principles of the protection of the basic rights of an individual.

The Bar Council is of the view that there must be a fair balance between legitimate national security concerns and fundamental liberties. This balance may be struck by the use of the justice system and the due process of law.

1) We need to call for the release of all those currently detained under Detention Without Trial Laws

2) We need to call for the Repeal of all Detention Without Trial Laws

- these 2 general calls must be part of all statements issued by the Bar with regard to any arrests, detention and/or usage in any manner the ISA and any other laws that allow for Detention Without Trial...

WHAT ELSE WOULD THE BAR BE DOING NOW WITH REGARD THIS DETENTION OF 4 LAWYERS AND 1 OR?

I believe that the Bar Council - should get the Human Rights Committee or a special task force set-up immediately to campaign for the release, as well as to (a) monitor developments; (b) assist in any way; etc . WE NEED AN IMMEDIATE CAMPAIGN.

It would be good is a special team of lawyers from Taiping is also identified to act for the Bar - given the fact that they are being detained in Kamunting.

Surely, it is not right

I had met Mano on 27.11.07 in Shah Alam Court. I told him that they would use the ISA on him. He was a bit disturbed but I supposed well understood the situation. Then true enough. Everybody made comments to justify the ISA. From retired politicians who would probably be not around tomorrow and not to mention those who want to stay in power forever. The rest is history.

But then Mano and his friends were never been given the opportunity to explain their part. I suppose that it is not important, or is it? Is it right to intimidate and scare off whoever opposes you? Would it resolve the problems?

What Tourism Minister said

Datuk Seri Tengku Adnan was reported in today's New Straits Times newspaper as saying "Before the rallies, about 30 to 40 tour buses came to Putrajaya every day. The number of late, leaves much to be desired. If they (tourists) are not coming, how are the bus drivers, tour guides and others going to feed their families?"

Firstly, Putrajaya, as a tourist destination, is overrated.

Secondly, the floods in the east coast are causing lots of people to lose income. Does that mean our Tourism Minister is suggesting that we put Mother Nature under ISA? I know, I'm using a silly extreme example. Sorry, just being Nazri Aziz-esque.

Thirdly, about the bus drivers and tourist guides who are apparently suffering - surely the government can set up a "Hardship Fund" for them? It won't cost billions like our Angkasawan project.

REPEAL THE I.S.A.

The Internal Security Act is a law that is totally repugnant, reprehensible and obnoxious. It should not have been used against the four plus one lawyers.

The Government has an adequate armoury of laws to mete out against the four plus one lawyers or all the lawyers without resorting to this outrageous piece of legislation which is targetted against the communists. It was never targetted against the rakyat.

I am in total agreement that the ISA has outlived its usefulness. Resort to the ISA to silence people who genuinely believe in the democratic expression of their grievances, real or imagined, only weakens the investigative culture of our police force and prevents issues from being ventilated.

The use of the ISA in any instance has never bee totally justified. It should be repealed by any self-respecting democratic government.

They must be tried in a court of law

Alex is right in his examples of how irrational and incoherent our ministers have become in justifying the use of ISA. One even quoted that the reservations in Bkt Bintang hotels have dropped 10% as a result of these "street protests" and now we have some obscure group from Johor writing to the PM commending him on his swiftness in using the ISA. Where were these people when kerises were brandished at meetings and calls of threats of walking on the streets armed with parangs were made?

The Detained 5 may not have been perfect but at the very least they deserved to be tried in a court of law. If The government cannot appreciate that, then we are no difference from a dictatorship.

Minister boleh

Malaysian Minister's Logic:-

1. When building crack - Samy says, its not my fault, its act of god.

2. When Bar Council voices out the right of Malaysian to assemble, after calling off HR Day walk - Nazri says, BC is coward (I still cannot see the connection between the calling off the walk and supporting the right to assemble, to being branded 'coward'??)

3. When Malaysian protest - Mohd Ali Rustam say, 'Revoke their citizenship'.

4. When Foreign TV report on rallies - Zainuddin reminds us all that Malaysia has an 'erection' once every 5 years.


Ministers MUST accept that they are akin to Directors of a Company, and we Malaysian are all shareholders in this "Company". They are responsible to us, like a Director is responsible to its shareholders. But then again, some of these Ministers may even need a class just to learn the meaning of 'responsibility'.
