Ragunath Kesavan Forum will go on, says Bar Council

The Bar Council wishes to address some concerns that have been raised in relation to the ForumConversion to Islam: Article 121(1A) of the Federal Constitution, Subashini & Shamala Revisited” which is scheduled to take place on 9 August 2008.

We respectfully disagree with the learned Home Minister, Datuk Seri Syed Hamid Albar that proceeding with the forum would provoke misunderstanding as he is of the view that it touches on racial and religious sentiments.

We are not challenging or questioning the provision of Article 121(1A) conferring jurisdiction to the Syariah Courts.

Our concern is that there are increasingly more families caught up in the conflict of laws arising from the conversion of one spouse to Islam. This issue of conflict of laws must be addressed and we all must work towards seeking an amicable and acceptable solution for all concerned parties.

The Bar Council is of the opinion that it is important that such conflicts are best addressed in an open, frank and mature manner by all the parties involved. It is for this reason that we have made an effort to put together a panel of speakers that represent the views of various parties.

It is not proper that the real problems faced by families embroiled in such situations be swept under the carpet, nor is it proper that discussions and forums organised in order to address such concerns be disparaged on the pretext that such forums can provoke misunderstanding.

There is no substitute for the legitimate airing of views and concerns especially when the Bar Council has taken great care and effort to be inclusive.

We must be prepared to grapple with issues no matter how sensitive or difficult it may be. The alternative to any ban or clamp down of any open discussion may be disastrous and counter productive. It is in keeping with this spirit of openness and transparency that the Bar Council has organised this Forum. We believe that the Forum will promote an in-depth examination of the issues involved and will help create a greater awareness of the complex issues that we need to resolve together as a nation.

We would also like to commend the willingness of the various organisations and individuals concerned who have agreed to speak on this issue.

FORUM AIMS AT PROMOTING UNDERSTANDING

We got to agree with the Bar Council that the issue here is that of conflict of laws arising from the conversion.

We also have to accept the fact that, as a multi-religious country where half of its population are non-Muslims, the issue of conversion has often caused "confusion" and even misunderstanding among the people of different cultural groups.

As a responsible body, therefore the Bar Council is a suitable forum for such an open discussion with the aim of clearing any confusion and misunderstanding among the public.

It is definitely not a case of interfering with the affairs of another religion.

My dear Chu Teck

I agree with your observation. The Malaysian Bar is a self-regulating body set up by statute. It has a definite role to play in the affairs of the nation as its development is evolving.

I am sure that all self-respecting lawyers will resent and rue the day when the discourse of our self-regulating Bar is dictated by ADA (arahan dari atas, or order from the top).

This obviously includes the son of my former Malayawata Steel (MYS) and Malayawata Charcoal (MYC) executive director Tan Sri Syed Jaafar Albar where, through the good offices of the late Mr (later Datuk) Tan Kim Yeow, the managing director, I served from ages 19 to 21 plus

My time at MYS was financially a disaster. I got a lot more while in government service. However, by virtue of the fact that I was transferred to the various technical (steel-making and rolling) and administrative departments (general administration, financial and sales and purchase), the exposure to one of the then top 10 Malaysian companies did prepare me for my subsequent foray into journalism.

For this exposure, I have to always thank my billionaire chin-lang whose grave at the Western Road Cemetery I still visit now and then to say a silent prayer for his repose.

My dear Chu Teck, like you, I and I am sure many other lawyers will support the present endeavour of the Malaysian Bar ... without fear or favour!

Building Faith Upon Faith

Unless the forum is over, no one should look at it in such a negative light, nor should we be so hopeful about such a forum.

We do not know as yet how the panel members will perform and as to whether the forum will indeed provide the expected enlightenment at all.

Now Badawi says that there should be more inter-faith dialogues. This decision, if true, without any mis-reporting, is a complete u-turn from his previous decision - when compared to his previous decision of banning such inter-faith dialogues!

Therefore, situations change and our responses need to change with the times too and allow ourselves to enlighten the public, especially the affected ones, rather than suppressing their pains.

Probably some 'leaders' ought to retire and be at peace with themselves if personal peace is what they want, and since they are still desirous of sweeping 'things/issues' under the carpet instead of explaining them - which if done, might cause them to have head-aches.

It is not right or proper for them to provide/create lame excuses, stressing on the pretext of issues being sensitive, etc., etc., etc. - just to 'simply conclude'.

Calling all lawyers - let us have some inter-faith dialogues!
Please email me re the venue, dates and times for such dialogues.

Beri peluang dan dengar dulu...

Saya kurang senang melihat isu pemelukan islam menjadi punca berlakunya ketidakadilan kepada satu pihak yang lain. Seolah-olah ia memaparkan Islam dipergunakan untuk melepaskan dirinya dari sesuatu tanggungjawab atau merampas hak yang dulunya adalah hak bersama sedangkan Islam pada asasnya amat mementingkan keadilan kepada semua pihak.

Oleh itu, kritikan dan cadangan yang membina dari Forum yang dicadangkan ini sewajarnya didengar dan diteliti terlebih dahulu.Yang baik diterima dan yang buruk ditolak.

Manakala pihak yang berwajib pula sudah tentu perlu mengambil langkah cepat bagi penambahbaikan apa jua prosedur pemelukan Islam kerana ia melibatkan pelbagai aspek yang jika tidak ditangani dengan baik sudah tentu akan dan selalu menimbulkan konflik yang akhirnya pihak-pihak terpaksa menyelesaikannya melalui mahkamah.

Sebagai contoh penambahbaikan undang-undang yang telah dilakukan pihak berwajib iaitu setelah pihak berkuasa mendapati ada pihak cuba murtad untuk membatalkan perkahwinan, maka telah dijadikan undang-undang bahawa sebarang percubaan murtad untuk membatalkan perkahwinan adalah menjadi satu kesalahan.(rujuk seksyen 131 Enakmen Undan-Undang Keluarga Islam P.Pinang 2004.Jangan ambil sikap tunggu dan lihat.

Saya berharap Forum tersebut dapat diadakan dengan cara profesional dan dapat melahirkan kritikan dan cadangan yang membina dan bukan menghina agar segala pandangan negatif pihak berkuasa tidak menjadi kenyataan.

Encik Mohd Azizan saya setuju sangant dengan pendapat yang saudara telah kemukakan. Saya harap forum ini akan diteruskan demi keadilan kepada semua pihak. Kritikan yang dan cadangan yang membina semestinya dapat menjernihkan keadaan. Saya percaya forum ini diadakan bukan dengan tujuan untuk menghina mana-mana pihak.

Bak kata pepatah "Buangkan yang keruh dan ambil yang jernih" kalau tak silap saya.

The implimentation

Those who in charge of the implimentation of the Islamic system (jabatan agama islam etc..) in Malaysia sometimes are so lackadaiscal in their works that any issue arising because of the so called 'clash' or 'dispute' between the Muslim and non-Muslim and the converts and many issues arising thereof put the Islamic principle itself in the wrong picture... it is not the principle itself at fault. it is the people. You can look how in many cases the jabatan agama islam handle the issues poorly. And the saddest part is that the government itself lacks the political will to correct this situation - due to their ignorance in Islamic principle itself..

It made in the eyes of non Muslims that Islam had wronged them which is supposed not to be happened because for all the years during the age of Prophet Muhammad SAW he never at once wronged the non-Muslim.

Where is the daawah, people?

I agree with Zuhaidie. The people in charge have taken a 'tidak apa' approach. This forum organised by the Family Law Committee is to discuss about what a person in Subashini's shoes can do, in the future.

This is NOT a forum to attack any religion.
