Press StatementAbdul Hamid new CJ

The Malaysian Bar congratulates Y.A.A. Dato’ Abdul Hamid Bin Hj Mohamad on his appointment as Chief Justice and Y.A.A. Tan Sri Dato’ Zaki Bin Tun Azmi on his appointment as President of the Court of Appeal. The Bar however admits of surprise at the appointment of Y.A.A. Tan Sri Dato’ Zaki Bin Tun Azmi to the position of the second highest office holder in the Judiciary given his very recent elevation to the Federal Court and given that there were other suitable candidates in terms of seniority and service in the Judiciary. There are the added concerns of his previous business interests and involvement in UMNO. We trust these concerns will be dispelled by a display of integrity and exemplary performance on the Bench by Y.A.A. Tan Sri Dato’ Zaki Bin Tun Azmi. Society must be left in no doubt that the Judiciary is free from any allegiances or alliances and that it is above reproach in all respects. The Judiciary can ill afford to regress to the past when there were perceptions of unacceptable influences in the justice system.

Having said that, we are confident that the Honourable Chief Justice, President of the Court of Appeal, Chief Judge of Malaya and Chief Judge of Sabah & Sarawak as the Heads of the Judiciary, will engage the Bar, and we therefore look forward to a new era of co-operation with the Judiciary to strengthen the administration of justice.

Ambiga Sreenevasan

Dato Zaki should RESIGN for the good of the Judic
written by Charles Hector, Wednesday, December 05 2007 11:10 pm

Tan Sri Dato’ Zaki Bin Tun Azmi, the former UMNO legal adviser, so soon after his sudden "express" elevation as a Federal Court Judge should never have been made the President of the Court of Appeal. In fact, by reason of his links to UMNO, he should never even been appointed a Judge. Now I would not be surprised that he would be our next head of the Judiciary - and that will really look bad for the Malaysian Judiciary. Remember that even though Zaki may be a good man and a good judge - but we must be realistic as to what will be the perception of the people. Would they think they can get justice if they have a case against UMNO or the government or some political personality in UMNO (or even the Barisan)? I think not - we need an independent judiciary. We do not want a person beholding to UMNO as the head of the judiciary. The sudden appointment straight to the Federal Court already smelled not right. Now this - being made the 2nd in the Judiciary.

What experience does this man have of the judiciary? A few months ... and now he is 2nd in command - something is really not right.. and what makes it worse is that in happens now - when we have this whole issue surrounding that "Lingam tapes"

Rather perturbed
written by Simon Hong Chee Keong, Thursday, December 06 2007 05:35 pm

Considering the recent allegations against the judiciary, I am rather perturbed by the appointment of Dato’ Zaki as the Court of Appeal President. I am sure that there are other more appropriate candidates in the judiciary.

I AGREE, CHARLES

Fellow lawyers

My views on the above matter concur with Charles Hector's as well as Simon Hong whose concern I also reflect.
