Press Release: MACC should refrain from commenting on matters under inquiry

It has been brought to Bar Council’s attention that the Malaysian Anti-Corruption Commission (“MACC”) has, through its counsel, reportedly made comments to the media, most recently yesterday (26 May 2011), with respect to some aspects touching upon the issues under inquiry by the Royal Commission of Enquiry into the death of Teoh Beng Hock.
We also note that despite MACC apparently not having had sufficient time to respect and comply with the deadline set by the Royal Commission for parties to file their submissions, MACC has found time to speak of it in the media. This amounts to an attempt to have an extended inquiry through the media, and is a breach of natural justice, bearing in mind that the allegations or comments by MACC were not canvassed with the relevant witnesses in the course of the inquiry.
The Malaysian Bar is of the view that this is not proper. Parties
should refrain from commenting in the media on the substance of the
matters under inquiry, pending the Commissioners’ report. The Malaysian
Bar has thus far declined invitations by the media to make comments of
such a nature.
