Press Release Bar Council to complete unfinished tasks in 2007/2008 Election
Bar Council taking steps to complete its election

The Bar Council met on Thursday 22 February 2007, to discuss the Council Elections in respect of the coming year. The Council took note of the sentiments expressed by the learned Judge in Foo Ton Hin’s case that the Bar Council should be the proper body to make the relevant decisions concerning the elections. We accordingly considered various options.

While remaining open to all options available to the Council in the matter, it is felt that the first priority would be the completion of the unfinished tasks of the election. Only then, and armed with the results of such completed task, will the Council be in a better position to choose or finalise the option that would be in the best interest of the Bar. Hence, the Council is taking steps to seek the assistance and cooperation of various quarters in order to achieve the above objective.

In its deliberations, the Council took into consideration, among other things, the following factors:

1) That it is the inherent right of the members of the Bar to know the full and true facts of the matter, and hence the duty of the Council to ensure that the truth is ascertained and made known to the members. Only then could informed decisions be made.

2) That the right and interest of honest and valid voters should not be easily subordinated.

3) That it would not be right to easily allow acts of sabotage to succeed.

4) That all ballots could have been verified, but not all have been so verified.

5) That statutory tasks should, to the greatest extent possible, be fully completed.

Accordingly, it is the Council’s decision that, in order to resolve the matter in the interest of the Bar, the first and immediate step is to ascertain the whole truth of the matter, which the Council seeks, as it has always sought.
