The Malaysian Bar Council views with disappointment the repeated incidents of highhandedness in the Police Force in carrying out the duties entrusted by them.

More recently, the manner of arrest of Mr. Sivarasa Rasiah, a member of the Bar Council is certainly inappropriate. Mr. Sivarasa has been called before by the police for questioning and he has always presented himself upon request. To send eight police officers to effect his arrest and for these officers to do so by barging into his office while he is in conference with a client and before all his staff and colleagues, is clearly an excessive and unnecessary use of the powers entrusted to the police.

The Bar Council also notes with regret the death of a young member of the medical profession, Dr. Tai Eng Teck, allegedly as a result of excessive and unwarranted use of police powers in attempting to arrest Dr. Tai.

The Bar Council wishes to remind the Police Force that the manner of arrest and other procedures undertaken preceding a final pronouncement by a court of law as to the guilt or innocence of a person must be carried out with the presumption of innocence as envisaged in our laws, at the forefront of their minds. The powers entrusted to the police are indeed considerable and it is imperative that utmost restraint and proper discretion should govern the use of these powers.
