The High Court today granted the application of Louis Edward Van Buerle setting aside the 59th Annual General Meeting of the Malaysian Bar held on Saturday 19th March 2005 at the Nikko Hotel as well as all decisions and resolutions passed thereat and the election of the principal Office Bearers of the Bar Council subsequent thereto. The Court further ordered the convening of a new AGM within 30 days of the Order.

However, an application for stay pending appeal was granted by the learned Judge.

Counsel for the Malaysian Bar will be filing an appeal to the Court of Appeal on an urgent basis. It is a good opportunity for the appellate court to decide this issue, which the learned Judge observed was a controversial one.

As a result of the stay, there will be no interruption in the carrying out of the functions under the Legal Profession Act 1976, by the present Bar Council.
