The Bar Council views with great concern the arrest and detention of a lawyer, P Uthayakumar, yesterday at the Sepang Magistrates Court.

The manner of the arrest and detention purportedly for an offence of criminal intimidation is clearly an abuse and an unwarranted exercise of police powers. We have now been notified that he has been released and rearrested for another purported offence.

The continued and consecutive detentions of Uthayakumar are clearly oppressive and clearly violate his rights and liberty.

It is the prerogative of the police to investigate offences. However, the detention of any person would affect that person’s liberty bearing in mind that a person is innocent until proven guilty.

Therefore all police detentions must only be exercised on proper basis and with sufficient justification.

Uthayakumar’s detention and rearrest are totally unjustified and are indicative of a clear abuse of police powers and the police must act immediately to release him.

The Bar Council is of the view that the police should exercise caution and further discretion in handling this arrest as the complainant is himself a police officer.
