Kenyataan Akhbar: Langkah yang tepat untuk sistem keadilan jenayah

Badan Peguam Malaysia mengalu-alukan keputusan Yang Arif Dato’ Mohamad Zabidin Bin Mohd Diah di dalam kes Pendakwaraya v Dato’ Seri Anwar Bin Ibrahim di mana Yang Arif telah mengarahkan pihak pendakwaan membekalkan kepada pihak pembelaaan dokumen-dokumen yang relevan dan perlu bagi pembelaan tertuduh sebelum bermulanya perbicaraan.
Antara lainnya, dokumen-dokumen tersebut termasuk nota-nota ahli kimia dan doktor-doktor, senarai saksi-saksi yang akan terlibat di dalam kes pendakwaan, pernyataan fakta-fakta yang menyebelahi pembelaan dan pernyataan-pernyataan saksi yang dirakam oleh pihak polis.
Kami percaya bahawa Keputusan Mahkamah Tinggi ini konsisten dengan polisi Kerajaan dalam penggubalan seksyen 51A Kanun Acara Jenayah (yang berkuatkuasa pada tahun 2007), untuk menjadikan sistem keadilan jenayah negara ini lebih sama rata (“equal”) di antara pihak pendakwaan dan pihak pembelaan, lebih terbuka dan adil.
Pembekalan dokumen-dokumen sebelum perbicaraan bermula juga akan menolong pihak pembelaan untuk menyediakan kes bagi tertuduh dengan lebih sempurna, dan akan menjimatkan masa Mahkamah di mana pihak pembelaan akan lebih bersedia dan akan mengurangkan penangguhan perbicaraan-perbicaraan untuk meneliti dokumen-dokumen yang baru dikemukakan.
Badan Peguam Malaysia berpendapat bahawa keputusan ini telah membuka satu lembaran baru di dalam proses keadilan di Malaysia setaraf dengan prinsip-prinsip antarabangsa.
