The Bar Council reiterates its call for an inquest to be held each time there is a fatality under whatever circumstances in the course of police operations. The Bar Council had previously called for an inquest or inquiry under Section 328 of the Criminal Procedure Code over the police shooting of five persons on October 2, 1998 at Taman Sungei Besi Indah, Kuala Lumpur and of six persons on October 3, 1998 at Tumpat, Kelantan, all in police operations.
An open inquest or inquiry has now become all the more necessary following the police shoot-out at the robbery at the BSN branch Kepong on January 8, 1999 where four persons were shot dead. According to the police authorities themselves one of the four persons shot dead was the bank teller and that their investigations so far do not establish any link between the late bank teller and the alleged robbers.
The Bar Council is of the opinion that an open inquiry or inquest by a Magistrate under the Criminal Procedure Code should become established standard procedure in the public interest in every case of death by shooting in the course of police operations. It is in the public interest that the circumstances of such deaths be established by judicial inquiry and by the application of judicial standards and the findings be disclosed to the public.
