Federal Court's decision on ISA welcomed PDF Print E-mail

The Federal Court’s recent decision in the case of Mohd Ezam Mohd Noor & 4 Ors v Ketua Polis Negara is of public importance in view of its implications on fundamental constitutional and human rights issues relevant to the subject of preventive detention in Malaysia generally.

The Bar Council welcomes in particular the Federal Court ruling that the test for Section 73 of the Internal Security Act is not a subjective, but an objective one. Detainin g authorities cannot continue to arbitrarily arrest and detain persons on general, unsupported claims of them being a threat to national security.

Noting the finding of the Federal Court that the arrests and detentions by police were unlawful because of mala fide in effecting the same, the Bar Council calls upon the Government to immediately release the appellants who are still under further detention by subsequent order of the Home Minister. Since initial detention by the police has been clearly proved unjustified, there can be no valid ground upon which the Government may continue to detain.

The Bar Council is further of the view that a speedy, unilateral decision to release by the Government following the decision of the Federal Court is not only the legally proper course of action, but also necessary to demonstrate the Government’s continued commitment to the Rule of Law in this country. Inaction on the part of the authorities will only render the Federal Court decision academic.
