Fatal shooting of 6 person in Tumpat PDF Print E-mail

 The Bar Council welcomes the recent decision (on revision) of the High Court at Kota Bahru on 15 September 2002 in respect of the inquest into the fatal shooting of six persons in Tumpat on 3 October 1998.

In the light of the finding of the learned High Court Judge that there were many unanswered questions behind the Tumpat Magistrate’s finding that the shots fired by the police were fired in self-defence, were reasonable and did not amount to a criminal act, the Bar Council is of the view that it is imperative for the police authorities to recommence their investigations into the incident. This should be the next necessary step since the substituted verdict of misadventure (the deceased persons having been shot by person or persons unknown) is a result of the insufficiency of evidence adduced in Court. It would be most unsatisfactory for the matter to stop at this stage when the exact identity of the police officers who caused the deaths remains unknown.

The Bar Council therefore calls upon the Inspector-General of Police to direct the relevant officers to conduct further investigations into the case or to recommence an inquiry in order to uncover all the evidence to identify the said police officers. The Bar Council urges the Inspector-General to act on an urgent basis in order to avoid a further delay of justice for the families of the deceased who were killed in October 1998.
