The Minister in the Prime Minister's Department, Datuk Dr Rais Yatim was quoted in the newpapers on Wednesday, 11 July 2001, as saying that the code of ethics for Judges was being reviewed with the objective of formulating a law whereby additional powers would be given to the Chief Justice to enable him to have more clout in enforcing the code of ethics for Judges.

While the Bar Council is mindful of the need for Judges to comply with the provisions of the Judge's Code of Ethics 1994 as well as being responsible, decorous and self-disciplined, the Bar Council is of the view that a certain degree of latitude ought to be afforded to Judges so as to enable them to exercise their discretion when carrying out their duties.

It is imperative that Judges keep their administrative duties, if any, separate and distinct from their judicial functions.

The additional disciplinary powers that the Minister has in mind which are to be given to the Chief Justice ought not in anyway dampen or hinder the spirit of judicial activism currently displayed by our Judges.

The independence of the Judiciary is sacrosanct and ought not to be compromised at any cost.

Judges ought to be at liberty to freely express their views relevant to a particular case. Any new rule of etiquette or discipline that is being contemplated ought not to have the effect of gagging the Judges or putting them in a straight jacket.
