Arrest of a university student under ISA PDF Print E-mail
Friday, 06 July 2001 12:00am

The Malaysian Bar regrets to note that a university student has been arrested by the Police yesterday under the Internal Security Act 1960. Once again, the Malaysian Bar would like to reiterate its stand that any arrest pursuant to the Internal Security Act constitutes a gross breach of fundamental human rights and an affront to the rule of law.

The Malaysian Bar is increasingly saddened by the continuing use of the Internal Security Act by the Police authorities for the purpose of carrying out police investigations. If the Police have sufficient grounds to suspect that the university student has indeed committed an offence, he should be arrested and investigated under the provisions of the Penal Code and/or other relevant laws and charged accordingly in Court where due judicial process is ensured. To arrest a person under the Internal Security Act is to effectively refrain him from seeking his democratic rights to be heard before a Judge.

The Malaysian Bar condemns any further arrests pursuant to the Internal Security Act where the persons arrested are detained without trial. The Malaysian Bar again calls on the Government to immediately repeal the Act.

Dated this 6th day of July 2001.

Mah Weng Kwai
Chairman
Bar Council
