The Bar Council refers to the recent appointment of the new Chief Justice of Malaysia, Tan Sri Dato’ Sri Ahmad Fairuz bin Dato’ Sheikh Abdul Halim and to his recent statements on the administration of the judicial system as published in the newspapers on 18 March 2003.

The Bar Council is encouraged with the determination of the new Chief Justice to create a transparent and efficient judicial system with good relationships with the Government, Attorney-General’s Chambers and the Bar Council. Following the efforts of the former Chief Justice Tun Mohamed Dzaiddin bin Hj Abdullah to improve the Judiciary, the proposed investigative approach with regard to public complaints on judicial administration is most timely and welcomed. The new Chief Justice’s proposal to remove corrupt judges from judicial office is an essential step in the right direction as the Judiciary cannot afford to retain even one corrupt judge, lest the entire administration of justice be brought into disrepute.

The Bar Council hopes that the new Chief Justice will lay these right foundations, among others, early on in his term and continue to restore public confidence in the administration of justice. In this, the Chief Justice can be assured of the Bar Council’s cooperation and support. In the past, the Bar has been regularly referring matters of concern, including complaints, to the office of the Chief Justice and the Chief Judge of Malaya through the Court Liaison Committee of the Bar Council and the Office Bearers of the Council. Such Bench and Bar discussions have proved to be helpful and the Council hopes they will continue for the betterment of the administration of justice in this country.

In addition, while the vacancies resulting from the elevation of seven High Court Judges to the Court of Appeal last year still remain, the Bar Council takes this opportunity to urge the new Chief Justice to prioritise the matter of judicial appointments so as to avoid the creation of a new backlog of cases, particularly in the Shah Alam and Kuala Lumpur courts. The Bar Council naturally welcomes consultation on this matter, and assures the Chief Justice of the Bar’s fullest cooperation and support in this regard.
