Admission of foreign lawyers on AG's special certificates

The Bar Council notes with regret the gazetting of the guidelines prepared by the Attorney General’s Chambers on the issuance of special certificates by the Attorney General to foreign lawyers under Part IIA of the Legal Profession Act, 1976 on 19th August 1999, in view of the repeated calls by the Bar Council to the government to repeal the said Part IIA.
The Bar Council further notes with regret that the said guidelines were gazetted by the Attorney General’s Chambers without prior notice to and dialogue or consultation with the Bar Council.
While the guidelines allow for foreign lawyers (and local lawyers) to be admitted to practise as an advocate and solicitor of the High Court, either as a consultant, employee or partner of a local firm, the guidelines regrettably do not provide for the period a person issued with such a special admission certificate by the Attorney General may practise as an advocate and solicitor. The Bar Council also views with concern that although it will be consulted before any certificate is issued by the Attorney General, the guidelines do not provide for such consultation before any certificate is renewed by the Attorney General.
The Bar Council, however, further notes with some small comfort that foreign lawyers admitted on a special certificate will have to comply with the provisions of the Legal Profession Act, 1976, including Part VII on disciplinary proceedings, with the exception of provisions relating to the issuance of the Sijil Annual.
