Proposed curfew for youths PDF Print E-mail

The Bar Council refers to the proposal by the Perlis State Government to impose a curfew from 10pm to dawn on youths aged 18 and below.

While the Bar Council appreciates that the number of youths involved in social ills may be on the increase, the imposition of a curfew cannot be the means by which the problem is to be addressed. The proposal is entirely unconstitutional in nature in that it deprives individuals of their constitutional rights under the Federal Constitution
to freedom of movement and association. In addition, the proposed curfew imposes a blanket prohibition on all youths in the proposed age bracket, irrespective of whether an offence has been committed or not.

The Bar Council is of the view that the proposal over-simplifies both the problem and the solution and avoids dealing with the substantive issues that affect troubled youths. Apart from being impractical in respect of its enforcement by the authorities, it also indicates that the State Go vernment is seriously misconceived both in terms of its authority to enact laws and its understanding of accepted legal norms.

The Bar Council therefore urges the Perlis State Government to reconsider its proposal and concentrate instead on improving existing and/or creating more positive methods to strengthen the family unit and win youths over from a life of delinquency.
