The Bar Council is deeply concerned at the death of Ragubathy Muniandy, a remand detainee at the Putrajaya Hospital on 28 July 2002 while under police custody. His relative had reported the deceased as pale, extremely weak and complaining of chest pain due to alleged police beatings during his interrogation when she last visited him on 23 July 2002 (Malay Mail, 29 July 2002). The relative had also reportedly 'begged' a police officer to take him to a hospital after she saw his condition, and claimed he would still have survived had he been treated earlier.
The Bar Council also views with concern the complaints by the family of the deceased regarding the alleged 'high-handed' behaviour of both police and Putrajaya Hospital authorities upon their requests for a post mortem to be conducted and the body to be released, which had apparently not been done even after 35 hours of the death.
Although the police have claimed they did all they could to help the deceased while he was under their custody, the circumstances surrounding his death as alleged by his relatives warrant an immediate and thorough independent investigation by the authorities concerned.
Seen in the wake of the death of S Tharma on 26 June 2002 while also in police custody, the Bar Council calls upon the Public Prosecutor to, if warranted by the evidence, take firm action to charge those responsible for the unlawful deaths or abuse of those in police custody. In the event there are no prosecutions, the Bar Council urges the Public Prosecutor to call for an inquest to be held by a Magistrate where the cause of death can be judicially ascertained.
