If you are thinking of setting up your own law practice, there are a few considerations that you need to bear in mind.  We have prepared some pertinent information and checklists to help you prepare before you decide to embark on a new journey.

The information provided is taken from the book Setting Up Practice that can be purchased separately or in a kit (START Kit).  The Start Up Checklist will guide your preparations step by step.  Other valuable information and checklists that may be used as a guide:


The Bar Council has set up a Mentors Project for those who would like advice and tips on setting up a new firm.   If you are a registered user of the Malaysian Bar website, you may click here to view the Register of Mentors.

The Getting Started! Workshop is available for Members who are thinking of establishing a new practice or partnership, or are in need of a refresher.  The workshop consisting of five sessions is delivered by senior lawyers and consultants: “The Fundamentals of Legal Practice”; “Accounting & Taxation”; “Bar Council & You: Obligations & Privileges”; “Conveyancing in a Competitive Climate”; and “Winning Ways through Civil Litigation Practice”.  Complete and submit the registration form to the Bar Council to participate in the workshop.

Statutory Requirements

As part of your preparation, write to the Bar Council and let us know that you are starting a new practice.  This should be in the form of a notice of intention to set up the practice.  It must be executed by the intending sole proprietor or all the partners.  The relevant rulings and requirements by the Bar Council, and the workflow for setting up a new practice can be viewed here

About the START Kit

The START Kit is the Bar Council’s legal starter kit that was launched in February 2011 as part of the Bar Council’s risk management programme to enhance the quality and standards of new lawyers in the country.  The kit is given on a complimentary basis to firms that have obtained their no-objection letter from the Bar Council.

Each START Kit contains advice and tips on practice essentials relevant to a new lawyer or a new firm.  The segments are divided into:

(1) START

This section contains two books (Setting Up Practice, Accounting for Lawyers) and a unique START Planner.  Setting Up Practice sets out basic information on the prerequisites, and the applicable rules and regulations to be complied with, in the setting up and running of a law firm.  Typical day-to-day problems that arise are also candidly discussed.  This book is complemented by the START Planner, which contains checklists, helpful references and materials on practice issues. 
 
(2) Best Practices

Risk management is a culture, not an event.  As a lawyer, ensuring high standards and quality service is crucial to keeping clients, minimising risks and enhancing productivity.  This section, complete with a Practice Area Checklist CD-ROM on litigation and conveyancing, Time Management and a Practice Alert! magazine, provides information and guidance on managing risk, time and staff.

(3) Office Management  

The heights a firm can achieve and its success are often determined by its culture.  The resources and tools provided here, Law Practice Management book and a DVD-ROM are to guide new firms in shaping a positive culture through its staff, systems and procedures from day one.

Members of the Bar who would like to purchase the START Kit can do so at the Payment Counter situated on the ground floor of the Bar Council Secretariat, or can have it delivered for a minimal fee.  Complete the order form to purchase the START Kit at RM50.
