Pursuant to section 57(a) of the Legal Profession Act 1976, the Bar Council has amended Ruling 14.21, as proposed by the Bar Council Legal Profession Committee.
The amendment to Ruling 14.21 is as marked below:
Bar Council Ruling 14.21: CreditReferenceReporting AgenciesIt is conduct unbecoming of an Advocate and Solicitor to disclose or forward information toCcreditReferencereportingAagenciessuch as CTOSof a person who is not his/her client, save for the purposes of correcting or updating information of his/her client and provided such client has instructed him/hernotwithstanding the client’s instructionsto do so.
The amendment to the Ruling is to enable a Member of the Bar to assist his/her client by forwarding his/her client’s correct or updated information, of which he/she is in possession, to a credit reporting agency, provided such client has instructed him/her to do so. However, it is still conduct unbecoming should a Member disclose or forward information of a person who is not his/her client, or if the Member has not been instructed to do so.
The revised Ruling 14.21 therefore reads as follows:
Bar Council Ruling 14.21: Credit Reporting Agencies
It is conduct unbecoming of an Advocate and Solicitor to disclose or forward information to credit reporting agencies of a person who is not his/her client, save for the purposes of correcting or updating information of his/her client and provided such client has instructed him/her to do so.
Please be informed that the amended Ruling takes effect immediately.
