NYLC 2006A day after the EGM, the National Young Lawyers’ Committee in a 4½ hour meeting on 17 November 2006 made several key decisions to chart the future of the YLC structure in the Malaysian Bar. This was necessary following the much anticipated repeal of s46A(1)(a) LPA.

The NYLC resolved as follows:

UNANIMOUSLY that State Bar YLCs and the NYLC should continue to exist as per the current structure adopted by the Bar Council.

UNANIMOUSLY re-affirming the aim of representing, protecting and promoting the interest of young lawyers within the Bar and to empower them to contribute to social good, and the 5 core aspirations of the NYLC decided in Selesa Hill Homes on 11 June 2006 as inter alia providing a platform for YLs to voice their views and concerns on issues affecting the Bar and assisting in the continuing professional development of young lawyers at the Bar.

BY A MAJORITY adopting a practical working guide in defining the target group of YLs being those under 40 years in age or 7 years in practice.

UNANIMOUSLY continuing the practice of inviting all members of the Bar to serve on the NYLC.

In this regard, the NYLC will continue to call for the identification and support of YLs in standing for elections to every State Bar Committee the next year.

I salute the NYLC for having decided, quite sensibly, not to commit collective hara kiri.

It caters to the biggest section of the Bar, the juniors, and it is obvious that this section has special needs, per se, which require sustained looking into and constant remedy. A stroke of the legislative pen, welcome though it is, in no way resolves these problems.

However, I have to question the ethics, or even the wisdom, of a policy of "identification and support of YLS standing for elections to every State Bar Committee". Stated barely like that it is as unseemly as saying that we will identify and support any Thais standing for elections. It is different if the policy means that the NYLC/SBYLC will identify outstanding YLs with leadership potential and urge and support their candidature.

Save for that caveat I would say that the NYLC resolutions have merit in them and should be accepted by the wider Bar membership.

We may have inadvertently made out that particular statement to sound just as you have read it to be. What we actually mean is that we would identify and support the YL's with the leadership potential such as the current state YL chairman for e.g. if they are inclined to stand for state bar committee.

We were understandably disappointed that not one YL took up the challenge to run for council this year but we understand that the LPA amendments had only gone through on the 2nd October 2006 and the YL would need more time than that to prepare and run for council. At any rate, the statement above was meant to show the candidates with leadership potential (should they decide to run in the near future) that they would have the support of the NYLC as well as the YL's in general.

We wish to add that we have encouraged and discussed the names of the YL's at the NYLC as well as at the State levels to run for seats at the state bar committees for the upcoming elections but whether they would or not we would just have to wait and see.

We also wish to add that the statement above does not imply that the NYLC and the YL will support ANY and EVERY candidate who is YL though it may sound like it. We sincerely apologise if the statement sounds as such and we thank you again for bringing it to our attention.
