BFM 89.9 Interview with Syahredzan Johan - Judges Have Right to Exercise Discretion in Nor Afizal Azizan Statutory Rape Case (15 Aug 2012)
Last week, the Court of Appeal unanimously overturned the five year jail term imposed on national bowler Noor Afizal Azizan for statutory rape of a 13 year old girl in 2009.
Instead, the court upheld the decision to bound over the accused for good behavior at RM25,000 as for the next five years after he pleaded guilty, a decision that has been criticised by NGOs but defended by certain quarters of the law fraternity.
In the following interview, Syahredzan Johan, chairperson of the Bar Council Constitutional Law Committee, discusses the legal perspective of the case, the need to review the Penal Code with regard to statutory rape and whether there needs to be a “Young Man’s Defence” in Malaysian law.
