KUALA LUMPUR: With an innocuous heading such as the “The Supremacy of the
Constitution", a session at the 14th Malaysian Law Conference 2007 instead
turned into one with the heading “We watched, we walked, we now ... do what?”
The original session was to be presented by Indonesia’s
president of the constitutional court Prof Dr Jimly Asshiddiqie but as he could
not make it at the last minute, the Bar Council improvised.
It instead held a session where the controversial video clip purportedly showing
lawyer Datuk V. K. Lingam allegedly brokering judicial appointments with a
senior judge was shown.
The video clip was played to a rapt audience in a theatre that was packed to the
brim at the Kuala Lumpur Convention Centre yesterday afternoon.
The session’s speakers were lawyers Fahri Azzat and Haris Ibrahim as well as
theatre practitioner Jo Kukathas who read out excerpts from the book Mayday for
Justice by Tun Mohameed Salleh Abas as revealed to K. Das.
Haris said the video clip incident was very worrying.
On what could be done, Haris said the Sultan of Perak Sultan Azlan Shah, in his
opening address on Monday, had given the lawyers a way out by saying there could
not be an independent judiciary without the Bar.
“The Bar’s extraordinary general meeting (EGM) is on Nov 22.
“The Bar must be prepared to take the necessary resolutions to stop this.”
He suggested the Bar consider not participating in the legal system until the
judiciary’s image improved.
Fahri said there were certain things Malaysians could do to arm themselves.
“We are alone. We only have each other. We have to arm ourselves with things
like bravery, standing up for what’s right, helping our fellow men and to see
each other as human beings who want to live together in harmony.
“We have to look at each other as brothers and sisters and say ’Enough!’. Until
then, we can’t do anything and will never be able to do anything,” he said.
During the question-and-answer session, a participant in the audience said the
problem was not getting the publicity it deserved, and suggested it be taken
internationally.
“It is time for the lawyers not to show up in court on one day all around the
country and show that the country can’t run without lawyers,” she said.
