Motion 1
1. TAKING cognizance of the Resolution passed with an overwhelming majority of
the Malaysian Bar at the Extraordinary General Meeting of the Malaysian Bar held
on 18.08.2006 at Wisma MCA, Jalan Ampang, Kuala Lumpur.
2. NOTING that the subject matter of the said Resolution i.e.
the 2006 Amendments (“the said Amendments) to the Legal Profession Act 1976 is a
matter which the current Bar Council ought to but did not bring to the prior
attention of the Malaysian Bar at a General Meeting pursuant to Section 57 (c)
of the said Act.
3. NOTING that the current Bar Council and or the current
officer bearers of the Malaysian Bar have not taken proactive steps to delay the
coming into force of the said Amendments:
4. FURTHER noting that the said Amendments were brought into
force on 2/10/2006;
It is hereby Resolved that:
a) The members of the Malaysian Bar have no confidence in the Office Bearers of
the current Bar Council namely, the President, the Vice-President, the Hon
Secretaray, the Treasurer as well as the immediate Past President, and Tuan Haji
Sulaiman b Abdullah to continue to lead, represent the interest and manage the
affairs of the Malaysian Bar and for their misconduct in actively working
against the interest of the members of the Malaysian Bar with regard to the said
Amendments.
b) Consequent to passage of the motion as aforesaid, the members of the
Malaysian Bar hereby solemnly call upon the President, the Vice-President, the
Hon. Secretary, the Treasurer, the immediate Past President and Tuan Haji
Sulaiman B Abdullah to forthwith tender as a matter of Honour their resignation
under Section 55(d) of the Legal Profession Act 1976 as Office Bearers and
Council Members.
c) Further the Member of the Malaysian Bar call upon the remaining members of
the Council to invoke Section 53 and 54 of the legal Profession Act 1976 and to
proceed to take all necessary steps to implement the recommendations of the
Ad-Hoc Committee as approved by the General Body of Members by respectfully
appealing to the Honourable Minister in charge of legal affairs in His Majesty’s
Cabinet for the support, cooperation and assistance of his good office in
pursuit thereof.
