The 51st AGM of the Malaysian Bar held at the Renaissance Hotel, Kuala Lumpur - Saturday, 22 March 1997
Saturday, 22 March 1997 12:00am
Number of Members present: 1,285
Motion 1:
To approve an increase in the annual subscription from RM175.00 to RM350.00.
Proposer: Bar Council
Resolution:
The Motion was carried with 238 votes in favour, 11 votes against and 2 abstentions.
Motion 2:
The rights and privileges of Advocates & Solicitors to appear and plead in all Courts of Justice in Malaysia without taking into account the number of years in practice is the hallmark of a fused profession in Malaysia.
Section 35(1) of the Legal Profession Act 1976 states that as between themselves Advocates and Solicitors shall have the same rights and privileges without differentiation.
To place the number of years as the yardstick to decide the privilege of audience before the Courts of Justice in Malaysia is arbitrary and this method is statistically unproven to produce Advocates and Solicitors who have mastered the rules of practice and procedure.
We therefore oppose any measure to amend the Legal Profession Act 1976 that will have the effect of removing the equality as between Advocates and Solicitors. We further oppose any proposal based on the number of years in practice as the yardstick determining the right and privilege of an Advocate and Solicitor to appear and plead in all Courts of Justice in Malaysia.
Proposer: Mr Ravindran Robin Mahendran Seconder: Mr Mathews George a/l George Mathews
Resolution:
The Motion was unanimously carried.
Motion 3:
That the Bar Council do set up a Library Fund from which money could be expended exclusively to purchase law books, law reports, law reviews, legal CD-Roms, discs and other necessary materials for law libraries in Kuala Lumpur and in other regions; and
That one half of the annual subscription paid by members to the Bar Council be set aside to constitute the said Library Fund and the Bar Council reduce all its other expenses appropriately; alternatively
That the Bar Council do levy Malaysian Ringgit One Hundred and Fifty (RM150.00) only from each member of the Malaysian Bar annually as a contribution to the said Library Fund.
Proposer: Mr A. Kanesalingam
Resolution:
The Motion was defeated with 17 votes in favour, 106 against and 27 abstentions.
Motion 4:
WHEREAS:
(a) In the last few years the agenda, annual report, minutes, accounts and other material have not been sent to, or received by, members within sufficient time before the scheduled date of the meeting;
(b) though this year’s annual general meeting is just some ten days away nothing has been received;
(c) this state of affairs and lackadaisical attitude must come to an end and members must be given adequate time to consider and study these materials before the meeting.
THEREFORE this House RESOLVES that this House directs the Bar Council as from the next statutory annual general meeting to ensure that the agenda, the minutes of the previous meeting, annual report, audited accounts and other material (except for member’s resolution) are sent and delivered to reach members not less than three weeks before the date scheduled for the appropriate annual general meeting.
Proposer: Mr R. Rajasingam
The Motion was withdrawn on the assurance by the Bar Council that it would not happen again next year.
