Number of Members present: 601

Motion 1:

To resolve that the Bar Council as a whole be censured for not responding to letters from its members and its lackadaisical manner over a complaint lodged against one of its members.

Proposer: Mr Wee Choo Keong

The Motion was withdrawn.

Motion 2:

To instruct the Bar Council President to make representation to the relevant authorities for the repeal of Section 46(A)(1)(a) of the Legal Profession Act; and

To instruct the Bar Council President to publish in INSAF whatever actions he has taken or to be taken on this matter.

Resolution:

It was unanimously resolved that the above resolution be passed.

Motion 3:

To resolve that the Prime Minister’s statement was uncalled for and it is likely to be construed as defamatory of our honourable organization;

That the President of the Bar Council be censured for abdicating his responsibility to defend the good name of this honourable organization when it was expected of him;

That President of the Bar Council send a telegram to the Prime Minister deploring his statement made on 25th January 1985.

Resolution:

It was decided by a majority that the motion be rejected.

Motion 4:

To consider legalising contingency fees in respect of personal injuries and industrial accident cases.

Resolution:

It was unanimously agreed that the matter be deferred as this was a subject for discussion at the forthcoming Malaysian Law Conference.

Follow-Up Action:

The Bar Council appointed a sub-committee to provide a model on how this matter could be regulated.

Motion 5:

(i) to provide for the number of representatives elected by each State Bar as its representatives to the Bar Council to be proportionate to the number of members in each State Bar; and

(ii) to provide for the number of members to be elected to each State Bar Committee to be proportionate to the number of members in that State Bar.

Proposer: Selangor and Federal Territory Bar Committee

Resolution:

It was agreed that the matter be dealt with by the in-coming Bar Council.
