I REFER to the question raised by M.N. regarding the house built by Port Klang assemblyman Datuk Zakaria Mat Deros ("Unasked question about a big mansion" - NST, Oct 23).

We have on several occasions explained through the NST and other newspapers that appropriate action has been taken on the matter.

Nevertheless, let me repeat that the maximum fine had been imposed over the house-construction plan and Zakaria had also relinquished his position as a Klang municipal councillor.

It must be emphasised that the state authority cannot simply tear down or sell the house he had built because the building plan was approved by the authority.

Zakaria was ordered to pay double the charge for the building plan, which he did.

This action by the authorities is provided for under Section 70 (14) of the Roads, Drains and Buildings Act 1974 (Act 133) and the First Schedule of the Standard Building by-law.

The authorities have the power to demolish buildings constructed in squatter areas, but Zakaria's house was built on his land.
