Subject: Information requirement.
Dear Mr. President:
As I inform you that the National Commission of International Affairs of the
Federal Council of the Brazilian Bar Association has opened administrative
process in order to evaluate the accusations of violation of Human Rights,
practiced against defenders of human rights in Malaysia, I am honored to address
you to forward a copy of the material that this Entity now possesses and to
request additional information regarding this matter.

WE, PARTICIPANTS OF THE XI NATIONAL ANNUAL MEETING OF
BRAZILIAN NETWORK OF GRASSROOT LAWYERS,
CONSIDERING,
- THAT we have learned from New Strait Times and Star Online about
the cruel violations of the right to expression conducted by the Malaysian
Government and His Excellency Prime-Minister Datuk Seri Abdullah Ahmad Badawi;
- THE imprisonment of pacific demonstrators during march realized last November
10, when members and supporters of Coalition for Clean and Fair Elections (Bersih),
tried to present a request for electoral reforms;
- THE imprisonment of Mr. Mohamad Sabu and Mr. Tian Chua, members of Coalition
for Clean and Fair Elections (Bersih) and another 13 persons, at least, under
the only allegations of being members of the Coalition;
- THE imprisonment of 9 pacific demonstrators under the allegation of taken part
of the celebration of International Human Rights Day, last December 10, among
them the lawyers Latheefa Beebi Koya, N. Sivarasa Rasiah and N. Surendran, and
Eric Paulsen, Anthony Andu, Arshad Ali and Noraza Othman;
- THE imprisonment of Mr. Edmund Bon, Bar Council Human Rights Committee
chairman due to the existence of banners proclaiming “International Human Rights
Day” displayed outside the Bar Council building;
- THE provoking speech of His Excellency Prime-Minister Datuk Seri Abdullah
Ahmad Badawi, saying that the arrestment of lawyers was a way to do not
discriminate;
- THE imprisonment of five other lawyers, P. Uthayakumar, R. Kengadharan, V.
Ganabatirau, M. Manoharan, and K. Vasantha Kumar, this last under the allegation
of being coordinator of Hindu Rights Action Force (Hindraf), and the others
under the allegation of being legal advisers for Hindraf and Human Rights
defenders, all of them subjected to the shameful application of the Internal
Security Act – ISA, instrument of dictatorship utilized by the Malaysian
Government to oppress people;
- THE dilatory maneuver utilized by the Malaysian Government to not accomplish
the judicial decision of Hon. Judge Zunaidah Mohd Idris, who ordered the
immediate release of lawyers P. Uthayakumar, V. Ganabatirau and Vaytha Moothy;
- THE new declarations of His Excellency Prime-Minister Datuk Seri Abdullah
Ahmad Badawi and other first rank authorities, saying that:
- the pleas for equality of Hindu people had hurt the country’s image and could
seriously impair efforts to attract investors and tourists;
- these pleas and others saying that in Malaysia there is no equality and that
there is an “ethnic cleansing” could be deemed a treachery;
- the demonstrations were pacific, but the police didn’t issued a permit.

- the Government will never accept street demonstrations as part of Malaysian
culture and that the Malaysian society as a whole rejects street demonstrations
and these have not in any way been able to change the government’s policies.
- the Government would sacrifice the people’s freedom on behalf of its security;
- THAT the right to free expression and pacific assembly are Human Rights
recognized at the Universal Declaration of Human Rights and the International
Covenant on Civil and Politic Rights;
- THAT Malaysia, as member of United Nations Human Rights Council is specially
compelled to respect those mentioned rights, refraining itself from violating
them, and is bound to protect them against violations of third parties and
fulfill them;
- THE universality and the interdependence of Human Rights;
DECIDE:
TO EXPRESS to the Government of Malaysia our concern with the freedom and the
physical integrity of all Malaysian political prisoners, specially those lawyers
who were victimizes just for exerting their profession and defend Human Rights;
TO EXPRESS our repulse to the terror regime ruled by His Excellency
Prime-Minister Datuk Seri Abdullah Ahmad Badawi, which denies respect,
protection and fulfillment to Human Rights, disregarding the UN Universal
Declaration of Human Rights and despising Malaysia as member of United Nations
Human Rights Council;
TO APPEAL to Brazilian Government to express our and its concern with the
situation of Human Rights in Malaysia;
TO APPEAL to all judicial professionals and to all Brazilian associations of
lawyers and other judicial professionals to express to Brazilian and Malaysian
governments asking for actitudes that could help to insure respect to Human
Rights in Malaysia;
TO APPEAL to all Human Rights defenders, in Brazil and in other countries, to
carry on campaigns for the liberation of all political prisoners in Malaysia,
for the banishment of the Internal Security Act and for the integral respect to
Human Rights;
TO EXPRESS to all Malaysian political prisoners, defenders of Human Rights,
their friends, relatives and fellows, specially to the lawyers arrested while
exerting their profession and defending Human Rights, our deepest solidarity and
disposition of acting to obtain their freedom.
